Advice on return of New Zealand s501 detainees from Australia

Dear Ministry of Business, Innovation & Employment,

The Australian government is currently holding a large number of New Zealanders in immigration detention pending deportation for reasons of character or past criminal offending under s501 of the (Australian) Migration Act. In Parliament the Prime Minister has suggested that there are barriers to these New Zealand citizens returning to New Zealand. I would like to request the following information under the OIA:

* all advice about the return of New Zealand s501 deportees from Australia. I am not interested in individual cases, but rather advice relating to this group as a whole (for example, how quickly they can be processed, what barriers there may be to return, and compliance with s18 BORA).

I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.

With regards to s12 of the OIA, I am an NZ citizen and in NZ.

Dear Mr Harris

Thank you for your email of 12 November 2015, requesting under the Official Information Act 1982 the following information:

“all advice about the return of New Zealand s501 deportees from Australia. I am not interested in individual cases, but rather advice relating to this group as a whole (for example, how quickly they can be processed, what barriers there may be to return, and compliance with s18 BORA).”

I am writing to advise you that the Ministry will provide a response but needs to extend the time available to answer your request. The Ministry’s response will be with you no later than 25 January 2016.

The reason for the extension is that consultations necessary to make a decision on the request are such that a proper response to the request cannot be made within the original time limit.

You have the right to seek an investigation and review of our decision to extend the time limit by the Ombudsman, whose address for contact purposes is:
