Dear Ministry of Justice
I am writing to request the following information under the Official Information Act 1982:
The number of immigrants who have been charged with sexual offences in New Zealand from 1 January 2010 to the present, broken down by calendar year.
If available, a further breakdown of how many asylum seekers have been charged with sexual offences during the same period, also by year.
For the purposes of this request:
"Sexual offences" refers to all charges categorised as sexual crimes under New Zealand law.
If full data is not available, I would appreciate any partial data or clarification on the limitations.
The purpose of this request is to inform an article I am preparing for publication.
Please do not hesitate to contact me if you require any clarification regarding this request. I look forward to your response within the statutory timeframe.

Thank you for your email of 28 April 2025 to the Ministry of Justice (the
Ministry), requesting, under the Official Information Act 1982 (the Act),
data on immigrants and asylum seekers who have been charged with sexual
offences. Specifically, you requested:
The number of immigrants who have been charged with sexual offences in New
Zealand from 1 January 2010 to the present, broken down by calendar year.
If available, a further breakdown of how many asylum seekers have been
charged with sexual offences during the same period, also by year.
For the purposes of this request:
"Sexual offences" refers to all charges categorised as sexual crimes under
New Zealand law.
The Ministry would like to inform you that we cannot provide a demographic
breakdown of this data by immigrant or asylum seeker status. However, the
Ministry can provide a breakdown by ethnicity (specifically European,
Māori, Pacific Peoples, Asian, Other or Unknown).
If you are seeking data on immigrants and asylum seekers, your request is
likely to be refused under section 18(g)(i) of the Act, as the information
is not held by the Ministry and there are no other grounds for believing
it is held by another agency subject to the Act.
Please can you advise how you would like to proceed with your request. We
can either:
1. Provide data broken down by ethnicity; or
2. You may wish to withdraw your request as data for immigrant and
asylum seeker status is not reported on.
We would appreciate it if you could respond no later than close of
business 5 May 2025.
Please note that under section 15(1AA) of the Act, on receipt of your
rescoped request, it becomes a new request for the purposes of the Act and
resets the timeline.
Under section 28 of the Act, you have the right to seek a review of the
Ministry’s handling of your request from the Ombudsman. The Ombudsman can
