Response to your request for Official Information 

 

On 17 February 2025, you requested the following information from Te Kāhui
Tika Tangata | Human Rights Commission (“the Commission”) under the
Official Information Act 1982 (“OIA”): 

 

“Please supply all information relating to the issues of workplace
bullying and/or sexual harassment at the Waitangi Tribunal since 2016 as
they relate to the records of the Human Rights Commission.”

 

We have no documents to provide to you and are refusing your request under
section 18(g) of the OIA because the information is not held and under
section 9(2)(ba) (see below).

 

The Commission has searched our electronic file system, and the email
mailboxes of several staff members identified as mostly likely to hold
this information, should it exist, and has been unable to find any
results. 

 

We are also unable to provide information about individual complaints of
discrimination (including sexual harassment), because the Commission’s
complaints resolution process is confidential. We withhold information
about discrimination complaints under section 9(2)(ba) of the OIA and
consider that the public interest in maintaining the confidentiality of
our dispute resolution process outweighs any public interest
considerations in favour of making the information available. 

 

We have not transferred your request to any other entity who may hold
information about “issues of workplace bullying and/or sexual harassment
at the Waitangi Tribunal” because you have been specific that your request
is limited to “as they relate to the records of the Human Rights
Commission.”

 

You have the right to seek an investigation and review by the Ombudsman of
this decision.  Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
