Regulatory Standards Bill Consultation - supplementary documents
Andrew Riddell made this Official Information request to Ministry for Regulation
The request was refused by Ministry for Regulation.
From: Andrew Riddell
Dear Ministry for Regulation,
You are currently consulting/seeking public views on a proposed Regulatory Standards Bill.
On your web site you identify supplementary information intended to help people understand the implications of a Regulatory Standards Bill.
This supplementary information includes an Interim Regulatory Impact Analysis and the Preliminary Treaty Impact Analysis.
Parts of these documents have been redacted, particularly the Preliminary Treaty Impact Analysis.
Please provide me with unredacted copies of these documents (save staff contact details which can remain redacted).
This is an urgent request because of the limited time until submissions close of this matter.
I also point out that the public interest in a full understanding of the implications of a Regulatory Standards Bill in order to make considered and constructive submissions outweighs any interest the Ministry or the Minister may have in suppressing assessments by Ministry staff on the implications of the Bill.
Ngā mihi,
Andrew Riddell

Thank you for your request, which we have considered under the Official
Information Act 1982 (the OIA).
Before proactively releasing documents on our website, we consider any
potential redactions as if they were being released under the OIA. This
includes redacting information where we have reasons for withholding under
the OIA, after considering whether there are any public interest reasons
favouring release which outweigh the reasons for withholding.
Our reasons for withholding the information redacted in the documents you
have requested have not changed.
Therefore, your request for these documents is refused under section 18(d)
of the OIA given they are publicly available.
Information which has been redacted under sections 9(2)(a) and 9(2)(h) of
the OIA continue to be withheld under those sections.
We acknowledge that there is a public interest in people having full
information when making a submission on the Bill. However, we do not
believe this public interest outweighs the need to protect the privacy of
individuals or to maintain legal professional privilege.
If you wish to discuss this decision with us, please contact
[Ministry for Regulation request email].
You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
