Dear Television New Zealand Limited,

I have heard through the Dilworth grapevine that a complaint was made against the Lost Boys of Dilworth docudrama that aired on TVNZ in April 2024. This was from Mark Easton, a former Dilworth student, also representing many other Dilworth Old Boys. Apparently, it asserts that I am not an abuse victim, nor is my friend Mark Staufer. As the main whistleblower in the Dilworth School sexual abuse scandal, I have encountered significant obstacles and opposition. Typical of many survivors, I have also encountered DARVO, an acronym for Deny, Attack and Reverse Victim and Offender. This is particularly distressing to me, hearing that my personal integrity and credibility may have been challenged. I therefore need to see this complaint to determine the nature and extent of this.

The Privacy Act allows you to request information about *yourself* (but not others). So it is possible to make a Privacy Act request (not OIA request) to request that portion of personal information in the complaint that relates to you.

In relation to TVNZ's decision to deny you the complaint on the grounds of 9(2)(a), this may apply to some of the information in the complaint. TVNZ could have chosen to redact information to protect the privacy of individuals, for example, names, and other identifying information. They could have then released the remainder of the information to you in the complaint.

In relation to TVNZ's decision to deny you the information using 9(2)(b), it is unlikely that the disclosure of the complaint would unreasonbly prejudice (harm) TVNZ's commercial position. TVNZ is effectively saying that their commercial position (i.e. their ability to make a profit) would be unreasonably detrimentally affected by releasing to you a letter of complaint. I could only see any commercial harm if someone were to sue TVNZ for breach of privacy in the release of the information but this is not actual harm, it is just a possible form of harm. TVNZ often rely on this withholding ground but it has been found over time to be overused without merit. and Prejudice would be more likely to occur from a reduction in commercial advertising, lack of strategic agility to adopt streaming, and incorrect interpretation of a collective employment agreement.

Under both the Privacy Act and the Official Information Act, you are entitled to the portion of the complaint that relates to you (under the Privacy Act) and the portion of the complaint that relating to other people and other matters (under the OIA) in so far as it does not breach the privacy of those other people.
