Thank you for your email of 15 November 2024 requesting information
regarding crashes related to temporary traffic management (TTM), which is
being considered in accordance with the Official Information Act 1982.

 

We are writing with regard to parts 1 and 2 of your request, which was
for:

 

Could you please make available all details related to reported TTM
incidents (crashes) reported to NZTA from 2015 to 2024. Ideally this would
be all the information that is on the CoPTTM Incident Report.

 

Are all the incidents within NZTA CAS?

 

It is difficult to glean from your request, in its current form, on what
specific information and documents you are seeking.  To enable us to help
you, and identify the information you are interested in, we would like you
to clarify these parts in turn as follows: 

 

1.       Can you please clarify if you are seeking information about
incidents involving roadworkers at roadworks sites, or crashes at or near
roadworks sites.  To clarify, incidents recorded on the CoPTTM Incident
database usually involve roadworkers at roadworks sites, whereas crashes
usually involve vehicles and occur in places where the public have the
right of access (for instance a road, highway or carpark), are reported to
NZ Transport Agency Waka Kotahi (NZTA) by New Zealand Police in the form
of a Traffic Crash Report (TCR).  Information from TCRs is then used to
update our our Crash Analysis System (CAS), whereas incidents at roadworks
sites with TTM are usually reported to WorkSafe and recorded on the CoPTTM
Incident database.

 

2.       CAS does not record details from the CoPTTM Incident database. 
Can you please clarify if you are seeking information about crashes
involving vehicles on roads at or near roadworks sites, or incidents
involving roadworkers at roadworks sites.

 

We look forward to being able to assist once the scope of your request is
defined.  It would be great to hear back from you by Thursday 21 November
2024.

Thank you for the information you have provided. However, this is not the information requested and does not allow for any further analytics. Of the fields on the CoPTTM Incident form I would only consider the following to be personal data, all of which could be easily redacted so that the rest of the data can be published:
- Reported By
- Company
- STMS name
- STMS No.
- Contractor / TTM Company
- Contact number

Given the move to a risk based approach to TTM I believe that NZTA has an obligation to make this data available so that the industry can undertake analysis of recorded incidents as part of their risk assessment.

Thank you for your further e-mail of 28 November 2024 requesting
information recorded on CoPTTM Incident forms.

 

While fields such as “Company”, “STMS name” and so on could be redacted
from CoPTTM Incident forms, releasing other information about incidents
would breach our confidentiality agreement with our suppliers and damage
the public’s trust in NZ Transport Agency Waka Kotahi (NZTA). Releasing
details about incidents also raises privacy concerns as certain details
could possibly identify individuals – and be in breach of the Privacy Act
2020.

 

NZTA is obliged to maintain confidentiality with its suppliers, and
safeguard the privacy of individual persons, to maintain the industry’s
and public’s trust in us.

 

This information is therefore withheld under section 9(2)(a) of the
Official Information Act 1982 as it is necessary to protect the privacy of
natural persons, including that of deceased natural persons. This
information is also withheld under section 9(2)(ba)(i) of the Act to
protect information which is subject to an obligation of confidence, where
making it available would be likely to prejudice the supply of similar
information, and it is in the public interest that such information should
continue to be supplied.

 

We can, however, advise that, in terms of the industry analysing incidents
as part of its risk assessment, NZTA regularly meets with Temporary
Traffic Management (TTM) industry representatives and stakeholders on
health and safety matters in relation to keeping road crews safe.

 

Under section 28 of the Act, you have the right to ask the Ombudsman to
review our decision to withhold this information. The contact details for
the Ombudsman can be located at [1]www.ombudsman.parliament.nz.
