Complaint against MPI

I wish to make a complaint about the refusal of the Ministry for Primary Industries to supply GIS (Geographic Information Systems) data for registered Emissions Trading Scheme forests for the Wellington Region.
The Ministry refuses to supply the information, stating that the information is confidential under s.99 of the Climate Change Response Act 2002.
I disagree with the position of MPI. I do not believe that the stated section can be used to refuse a request under the OIA. Instruments relating to approved applications under the CCRA are registered on titles. The Land Transfer Act Land Register is, and has always been, fundamentally a publically accessible record. As such the information registered on titles must be considered subject to the exemption of 99(2)(b)(ii). Furthermore, the availability of the information is provided for under 99(4)(c), that is the application of certain classifications is to be publicly knowable.
