Kia ora,
The information you have requested is withheld in full under the following
sections of the Act:
o Section 9(2)(b)(ii), where its release would likely unreasonably
prejudice the commercial position of the person who supplied the
information;
o Section 9(2)(ba)(ii), to protect information that is subject to an
obligation of confidence and making it available would likely damage
the public interest; and
o Section 9(2)(c), to avoid prejudice to measures to protect the health
or safety of the public.
I have considered the countervailing public interest in release in making
this decision and consider that it does not outweigh the need to withhold
at this time.

COVID-19 vaccine procurement process and the nature of the commitments

Dear OIA Requests,
Your response to my request above is exceedingly surprising and gives the distinct impression that a decision to withhold the information requested by me had already been taken by OIA Services Team.
Your denial of my request is basically a blank denial of information that is vital to the public interest, transparency of government, and denial of information that directly and indirectly affects almost all of New Zealand's population.
There is an enormous amount of evidence that indicates the public were fed lies by our Government and its Officials, from the very top to the bottom of the political and civil service cabal.
Your reasons are:
o Section 9(2)(b)(ii), where its release would likely unreasonably prejudice the commercial position of the person who supplied the information; Question: who is the "person" who supplied the information and what prejudice do you foresee ? How does this possible "prejudice" of one person outweigh the interest of the public of 5.5 million people who reside in New Zealand ?
o Section 9(2)(ba)(ii), to protect information that is subject to an obligation of confidence and making it available would likely damage the public interest; Question: making the information public in fact would be very much in the public interest; it would not damage it. On the contrary, by withholding this information you are seriously damaging the public confidence in the Government and the civil service. Do you not think that people are entitled to know how they have been treated by the Government ? Do you not consider that by withholding this information you are creating an atmosphere of conspiracy by government to hoodwink the population ? There is already much discussion around how and why the Government signed such a contract, even to the point of suggesting that perhaps bribery and corruption were involved
o Section 9(2)(c), to avoid prejudice to measures to protect the health or safety of the public.
Question: are you saying that you are wary of the public refusing to be, say, vaccinated against other illnesses if this information were to be released ? I would suggest that, on the contrary, by withholding the information you are creating a climate of fear among the population and people will not participate in any future vaccination campaign.
In light of the above, I again request that you release the information to the public as the information is very, very much in the public interest, although it may put a few individual political and civil service personnel in the spotlight, but of what consequence is that compared with the right of the population to hold them to account.
Yours sincerely,
F. Sharpley
