Copy of Legal Opinion sort regarding ULEB (Ultra Low Emission Wood Burners)

New Zealand Home Heating Association Inc made this Official Information request to Canterbury Regional Council

Response to this request is long overdue. By law Canterbury Regional Council should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

Dear Canterbury Regional Council,
Just some more Documentation we require by New Zealand Home Heating Association.

As we believe it the Minister was given the right to override the RMA by the way of Canterbury Earthquake Recovery Authority .But looking at the purpose of CERA
we believe that this power should have been restricted to maybe limiting the standard to sub 0.5 (or whatever) on our existing test .
From what we can see the Minister may have overstepped this power by creating CM1.4 a completely new unproven test with many well documented issues .
We are struggling to understand the legislative changes made to allow the new CM1.4 test to be deemed the new testing authority for ULEB,We have been made aware of a Legal opinion on the mater sort by Environment Canterbury if this is the case that would be then a public document and it would be of great benefit for us to have a copy of this .
In Essence This Document should obviously back up the reason you have undertaken this whole ULEB testing process .
Our aim here is to co-ordinate all new legislative changes with the product development and support from the manufacturers ,to all work together on this one .How ever as you well know, many questions are continually being raised about the validity of the test and if we could firm this up with our members by once and for all providing the legal avenue you have taken to derive a new test, it would be of great benefit to all.
