Please can you advise:

1) How many of your staff work from home on a permanent basis.
2) Approximately what proportion of your staff are in the office each day, on average.

If you do not have the above information, please provide any information you have created within the last 12 months (including but not limited to internal emails) discussing the extent to which Ministry staff attend the office versus working from home.

Dear Mailbox - OIA,

Thank you for your response. However saying that you do not hold records "centrally" is not a valid reason for refusing an OIA request. You are obliged to release all information that the Ministry has, and that information includes all information that is held by officials within the Ministry (whether that information is written down or not). Therefore, the fact that information is not held centrally is not relevant. The relevant question is whether it exists at all.

So once again, I would be grateful if you could provide the information that I requested, whether or not it is "held centrally".

Thank you for your reply email.

We have carefully considered your email and in regards to your second question seeking "approximately what proportion of your staff are in the office each day, on average", we can confirm that Te Puni Kōkiri does not hold this information.

Te Puni Kōkiri does not record or report on the proportion of staff in the office each day, to enable us to work out the average. Therefore, our decision to refuse this part of your request under section 18(g)(i) of the Act still stands, as the information requested is not held.

We also note that in order for us to answer your question, we would be required to create information that is not currently held. Agencies are not required to form an opinion or create information to answer an official information request.
