Thank you for your request for information dated 10 March 2023 to the
Ministry of Business Innovation and Employment (MBIE) for the following
information under the Official Information Act 1982 (the Act):

“Dear Ministry of Business, Innovation & Employment, Please provide a copy
of documents prepared in relation to the review of the list of
occupational disease set out in Schedule 2 of the Accident Compensation
Act 2001. Please also provide a copy of the draft and final report of the
panel of independent health experts in reviewing the list of occupational
disease set out in Schedule 2 of the Accident Compensation Act 2001. Yours
faithfully, Percy Doyle”

 

We have undertaken the initial scoping exercise for this request and have
identified two types of documents prepared in relation to the review of
Schedule 2; the first are policy documents and the second are procurement
documents. We would now like to clarify some aspects of your request to
better understand the type of information you are requesting.

 

Are you requesting just the policy documents? This scope would include
briefings to the Minister(s) for ACC, Cabinet Papers, a Non-Parliamentary
Paper, an Aide Memoire, and the Summary of Submissions to the public
consultation on additions to Schedule 2.

Or, are you also seeking the procurement documents? This scope would
include the general Request for Quote, the Procurement Plan, and Terms of
Reference template. Please note that this would not include content in
relation to the development of the draft or final panel report.

 

We note that, if you are considering the procurement documents in scope of
your request, this would increase the volume of content in scope of your
request and, consequently, we may need to seek an extension under section
15A(1)(B) of the Act. This is because the consultations necessary to make
a decision on the request may be such that a proper response cannot
reasonably be made within the original time limit.

 

Please also note, any clarification or amendment of a request is
considered to be a new request for the purpose of calculating the maximum
statutory timeframe for response as per section 15(1AA) of the Act.
However, we will still respond to your request for information as soon as
practicable and we note than the initial scope of your request has been
completed.
