Section 222 of the ERA states: Nothing in the Official Information Act 1982 applies to any information held by the Department or the Authority or the Court in relation to any proceedings brought before the Authority or the Court.
Section 222 is not a blanket cover to stop all requests for data or information collected about the ERA. Section 222 specifical relates to proceedings brought before the Authority or the Court.
We are requesting information about complaints about members of the ERA. We are not seeking information about any specific proceeding or applications. This request relates to members' performance and employees' data.

Dear Brooke van Velden,
I am in receipt of your response. However, I hold the view that your reply
has been incorrectly submitted.
Section 222 of the ERA states: Nothing in the Official Information Act
1982 applies to any information held by the Department or the Authority or
the Court in relation to any proceedings brought before the Authority or
the Court.
Section 222 is not a blanket cover to stop all requests for data or
information collected about the ERA. Section 222 specifical relates to
proceedings brought before the Authority or the Court.
We are requesting information about complaints about members of the ERA.
We are not seeking information about any specific proceeding or
applications. This request relates to members' performance and employees'
data.
We request that you review your grounds for declining our requests. Again,
we are not seeking any material information regarding any proceedings but
data. Section 222 does not apply to this request.
Please review our request at 1,2,4 and 5.
In response to 3 of our requests, directing us to the Website for
information on how to make a complaint is unhelpful and did not adequately
respond to our request for policies. The Website is a process to "make a
complaint" . This was not the nature of our request. We asked for the
policies or processes that are used to deal with complaints about members.
To clarify our request, we re-state:
1. What are the internal policies relied on by any decision-maker or
manager following a complaint
about a member?
2. Is there a code of conduct for members of the ERA. Is there any
internal policies for conduct or
behaviour for members of the ERA.
3. What internal code of conduct or internal policy is relied on when
investigating a complaint about a
member?
4. If a member is subjected to a complaint, what are the internal policies
relied on to conduct any
inquiry?
