3-12 months of work condition for Skilled Migrant Visa

Mrs. Louviere made this Official Information request to Ministry of Business, Innovation & Employment

This request has an unknown status. We're waiting for Mrs. Louviere to read a recent response and update the status.

From: Mrs. Louviere

Dear Ministry of Business, Innovation & Employment,

The page for the Skilled Migrant Visa (https://www.immigration.govt.nz/new-zeal...) states that the applicant needs to stay in the job they applied with for 3 or 12 months after starting employment depending on if the employment is in Auckland or not.

According to this faq (https://www.immigration.govt.nz/new-zeal....) it is possible to change your employer even if you have not met those requirements.

I would like some clarity on this. If my employment changed while on this visa before I met this requirement, would I need to stay with the new employer for the full 3 or 12 months or would the time spent with the previous employer count toward that?

As a hypothetical example: say I got employment outside of Auckland and received a Skilled Migrant Visa. I am supposed to stay with that employer for 12 months but I end up changing employers after 6 months. Would I have to stay with the new employer for a full 12 months to fulfill the condition? Or would I only need to stay with this new employer for another 6 months (since I had 6 months with the previous employer)?

Yours faithfully,
Mrs. L

Kia Ora Mrs L,

Thanks for contacting us.

New points system
From 9 October 2023 you will need 6 points to apply for the Skilled Migrant Category Resident Visa.

You can claim 3 to 6 points from your:
• New Zealand occupational registration
• qualification (bachelor’s degree or higher), or
• income from your job or job offer (earning at least 1.5 times the median wage in New Zealand).

You can only claim points from 1 of the above skill indicators. You cannot combine points from multiple skill indicators. For example, you cannot combine points from your qualification with points from your New Zealand occupational registration.

You can also claim 1 point for each year of skilled work in New Zealand, up to a maximum of 3 points.

The points you claim from skilled work in New Zealand can be combined with points from your New Zealand occupational registration, qualification, or income.
