Holiday period speeding tickets

Could you please provide records of how many speeding tickets were issued in the "official holiday period" over Christmas/New Years for the past 5 years, including this years' one.

If your system allows, could you please break down the speeding tickets issued into categories of the speed recorded. For example, the number of tickets 10km/h over, 20 km/h over, 30km/h over and so on.

I am a New Zealand citizen, as required under s12(1) of the OIA Act 1982.

Complaint sent to Ombudsman today:

I wish to make a complaint against the New Zealand Police in regards to a request I sent to them and the response I received under the Official Information Act 1982.

I send most of my OIA requests through the site FYI.org.nz. This was the case for this request as well. All correspondence is publicly available online at the link provided below. There have been no other communication regarding this request made through any other channels.

My complaint is with regards to the refusal of information under s 18(d), with regards to this year's results. I am happy to, and have, accessed previous data for which I requested online at the link provided by the Police. It is the first refusal I wish to complain about.

It is my understanding that there is no definition of what constitutes what "soon to be released" equates to - it is judged on a case-by-case basis. My complaint to you is that over a month is not "soon" enough and that this information should have been released. There is major public interest in this area considering the media around the issue and the campaign that was run by Police. There has even been a review set by the Minister for this area! If Police have the data available now, it should be released as soon as practicable. Holding out from releasing this information for over a month is against the Act as there is "no good reason" for withholding the information for such period of time. It would be my submission if just over a month is considered "soon" enough then this could degrade the Act and it's purpose. It could give too much power to public entities to delay the release of information from legitimate requesters.

I take an active interest in the Act, it's working, the Law Commission Report and other commentary on its interpretation (both by your office and others) so would appreciate full and complete reasoning for your decision.

Please feel free to contact me if you cannot access the link or need further information. Please do so in writing only as I like to keep records of all correspondence.

I look forward to a swift decision, in light of the Police release date of the information and in that I would like that information before that release, if I am successful in this complaint.

I doubt Police have that info in any releaseable or collated form yet. It will be a convoluted, ugly mess of data and there will be a bunch of protocols governing their public release (pretty sure it's a Tier 1 statistic)

That may well be the case, but they refused the request based on 18(d), not 18(f). Maybe if they had refused under 18(f), and explained when it would be in a form to send out, there may not have been a need for the complaint. However, this is an issue of how long a public body can withold information under the provision of 18(d).
