Thank you for your official information request which we received on 17
July. You asked us

 

Please provide me with all policies, information, and internal and
external communications regarding the use of public bathrooms by
transgender people, especially with their ability to elect whether to use
a male or female bathroom depending on what they identify as.

 

We recognise the importance of having facilities that are accessible to
people of all gender identities. While Auckland Council does not have a
policy on this, each facility is managed by the council in accordance with
guidance from the Human Rights Commission.  Many of our public facilities
provide unisex or accessible toilets and private cubicles within changing
rooms to ensure everyone can feel safe and comfortable. As per the Human
Rights Commission guidelines, where gender neutral bathrooms are
available, transgender people are not required to use them. People have
the right to use a bathroom that matches their gender and that they feel
most comfortable in.

 

The part of your request which asks for all internal and external
communication regarding the use of the use of public bathrooms by
transgender people is too broad and after discussing this part of your
request with our Parks and Community Facilities Department we know there
is likely to be a very large amount of information across many parts of
the council. Could you consider narrowing the scope of your request by
giving us subject matter or timeframe or a particular part of the council.
Or you could explain in more detail what it is you are looking for. You
are welcome to call me to discuss.
