Dear Department of Internal Affairs,

1. Please release all Local Government briefing papers in their entirety which were presented to the Minister of Local Government (Nanaia Mahuta) between the dates of 01 January 2020 and 31 July 2021 and where the Three Waters Reforms was the subject.

2. In a Local Government Briefing dated 26 February 2021 and titled "Three Waters Review: Maori rights and interests", the Department of Internal Affairs referred to te ao Maori rights in water. Specifically, in paragraph 9, it said "From a te ao Maori consideration of water issues, the proposed reform of three waters service delivery arrangements is narrowly focused…". Paragraph 10 then goes on to summarise the results.

2.1 Could you please release the details of that "te ao Maori consideration", what it contains, how it was conducted and who it was conducted by (e.g. Iwi, Department officials or someone else)?

3. Was anyone outside of the Department of Internal Affairs involved in the "Te Ao Maori Technical Working Group" for three waters? If so, what agencies?

4. Please release the "specific advice" that the Technical Working Group provided DIA as mentioned in paragraphs 13 and 49.

To provide a satisfactory and effective response, we would like to further refine and clarify the scope of some parts of your request.

Regarding Part 1 of your request for:

"1. Please release all Local Government briefing papers in their entirety which were presented to the Minister of Local Government (Nanaia Mahuta) between the dates of 01 January 2020 and 31 July 2021 and where the Three Waters Reforms was the subject."

The current scope of your request is likely to be refused due to the substantial collation necessary to provide a complete and accurate response. There are many briefings to be considered over the specified timeframe that will need to be compiled and retrospectively reviewed and approved for release by a network of both internal and external parties.

We recommend the following options to refine the scope of part 1.

• As the scope is very broad in terms of timeframe and content, we believe it may be most helpful and efficient to narrow the timeframe in scope and then request a list of titles of briefings over a period of 1- 6 months. You will then be able to make any following requests for specific information from the list which may be managed more efficiently to satisfy the intentions of your request. This is a common procedure when broad requests for advice to the Minister are considered.

It would be helpful to clarify the expectations of information relating to the details 'of that "te au Maori consideration" ' requested in part 2.1. Are you able to identify further the nature of the documentation or information that would contain the specific 'details' you are expecting to be in scope of your request? Any further description of this part of your request will enable us to better locate any relevant or significant information and respond as soon as possible.

Thank you for your email asking for clarification on my OIA requests.

Regarding Part 1:

Your advice to search the archived documentation was genuinely helpful and is sufficient to meet that part of my OIA request. I will bear in mind your advice on asking for titles of briefings in the future should a further OIA request be necessary, but at the moment, it is not.

Regarding Part 2:

I originally wrote this OIA request email to understand how the Department of Internal Affairs undergoes, prepares and produces a te ao Maori analysis on various issues. This is largely why my request under Part 1 was so broad, because I wanted to see how DIA engages with said issues.

I presume that DIA engages with Iwi/Maori via a specific working group to identify te ao Maori issues, then produces a summary (i.e. the "Hui-a-Motu summary report"), which is then presented to the Department, considered for implementation, and ultimately referenced in the Local Government Briefing (LGB).

By "details", I am looking for documentation containing consideration and/or analysis of the te ao Maori water issues (from the Hui-a-Motu report or elsewhere) that DIA considered before producing the 26/02/21 LBG. In other words, I am trying to find the analysis which DIA referenced in paragraph [9].

I hope that is sufficient to clarify my request. If not, please let me know, and I can amend it further.
