How many extentions to extend a passport cancellation has the Minister made?

Alex Harris made this Official Information request to Minister of Internal Affairs

The request was successful.

From: Alex Harris

Dear Minister of Internal Affairs,

Section 8A of the Passports Act 1992 allows the Minister to cancel a passport for reasons of national security. Such a cancellation lasts for 12 months, but section 8A(3) permits the Minister to apply to the High Court to extend the period of cancellation for a further 12 months. I would like to request the following information under the OIA:

* How many times in the last three years has the Minister made an application to the High Court under s8A(3)? On how many occasions was it successful? I'd like a breakdown by year.

As this issue is the subject oc urrent urgent legislation which will be presented to the House in two weeks' time, I ask that this request be handled urgently.

I would prefer to receive an electronic response. Queries about
this request will be automatically forwarded to me by the
fyi.org.nz website.

With regards to s12 of the OIA, I am an NZ citizen and in NZ.

Yours faithfully,

Alex Harris

Subject: RE: Official Information Act request - How many extentions to extend a passport cancellation has the Minister made?

Dear Alex,

Thank you for your Official Information Act 1982 (the Act) request of 11 November 2014.

In your request, you asked "How many times in the last three years has the Minister made an application to the High Court under s8A(3)? On how many occasions was it successful? I'd like a breakdown by year."

No application to a Judge of the High Court has been made for an order to extend a cancellation of a New Zealand passport on the grounds of national security using the provisions of section 8A(3) of the Passports Act 1992.

Thank you again for writing.

Yours sincerely,

Office of Hon Peter Dunne
Minister of Internal Affairs
