Good afternoon Erika,

Thank you for your email of 2 January 2023 requesting the following under the Official Information Act 1982 (the Act):

2. INCLUDING the users and keywords flagged in your system (eg in an excel spreadsheet)
3. The guidelines and objective documents used to complete the initial set up this Takedown Portal.
4. This request is for all of 2022 1 Jan - 31 Dec 2022."

For all new requests under the Act that concern digital safety, we require evidence of eligibility. Under section 12(1) of the Act, to be eligible to request information under the Act, you must be a New Zealand citizen or permanent resident; or a person in New Zealand.

In that context, we would appreciate if you could confirm your eligibility under the Act by providing a copy of a New Zealand identity document (such as a passport or driver's licence) or by providing evidence that you are a person in New Zealand (such as a utility bill that shows your current name).

To safeguard your privacy, this evidence should be provided to Te Tari Taiwhenua | the Department of Internal Affairs at [email address]. We would be grateful if you could confirm your eligibility under the Act by Friday, 20 January 2023.

Please note that if you do not provide evidence of eligibility, we will be unable to respond to your request.

Dear DIA,
In this OOA, I have asked for the settings of the takedown portal and you have said:

…documents are withheld in full under section 6(b)(ii) of the Act, as the making available of that information would be likely to prejudice the entrusting of information to the Government of New Zealand on a basis of confidence by any international organisation.

Have you considered the confidence of New Zealanders knowing that the government is censoring using Facebook ?
Have you considered that this OIA is an internet published response?
Have you considered the NZ Bill of Rights 1990 includes freedom of speech and portals that take down certain speech is breaching this law?

Yours sincerely,

Erika Whittome

Dear minadviceteam,

Complaint made to the ombudsman.
Section 3 and 6 of the nz bill of rights says that government is also bound by NZBoRA.

Yours sincerely,
