The Ministry advised that the service had been a pilot and was now (suddenly) discontinued.

Can I have a copy of the evaluation report for the DRP, and all related internal and external communications (emails, notes, meeting minutes, or similar) in relation to the DRP service?
Can I also have a copy of all communication with the Minister of Education or his representative, in regards to the withdrawal of the service?

Thank you for your request on 17 November 2022 for the following
information:

 

•            Can I have a copy of the evaluation report for the DRP, and
all related internal and external communications (emails, notes, meeting
minutes, or similar) in relation to the DRP service?

•            Can I also have a copy of all communication with the Minister
of Education or his representative, in regards to the withdrawal of the
service?

 

This email is to provide context on the Learning Support Dispute
Resolution Process (DRP) and secondly, to seek clarification on part of
your request.

 

The Dispute Resolution Process (DRP):

 

The dispute resolution process pilot added independent mediation as
another option for support when a dispute arose between parents and
schools.

 

This arrangement was available through a time-limited Memorandum of
Understanding with the Ministry for Business, Innovation, and Employment
(MBIE).

 

We worked in partnership with the New Zealand Schools Trustee Association,
and with advice and guidance from the Government Centre for Dispute
Resolution to establish the pilot. Input was also provided by the New
Zealand Principals’ Federation and the Secondary Principals’ Association
of New Zealand and other specialist interest groups.

 

The pilot was resourced from May 2018 until June 2019.

 

Very few requests for formal dispute resolution were received. Only two
cases advanced to the formal mediation stages. In other examples where the
option of using the pilot programme was requested, parents decided to take
other pathways, such as changing schools and/or withdrawing from the
process.

 

Funding was time-limited to June 2019 for the MBIE-supplied mediators.

 

A review of the DRP was not carried out because only two cases went to
mediation. This did not allow sufficient data and information, including
participant feedback, to be able to identify the pilot’s strengths,
weaknesses, and potential areas for improvement.

 

Information that was previously online regarding the Dispute Resolution
Process was removed as it was out of date. We apologise for this.

 

Your Request:

 

We invite you to clarify part of your request on the DRP.

 

As currently worded, your request for ‘all communications related to the
DRP service’ lacks due particularity and likely brings into scope a
significant amount information dating back to early 2018 pertaining to the
policy design, its operation, and personal matters for those who used the
service. Communications will have been generated by employees across five
Education regions, some of which are no longer employed with us, meaning
this information is not readily retrievable.

 

With this in mind, we would likely refuse your request for ‘all
communications related to the DRP service’ under section 18(f) of the Act,
as the information cannot be made available without substantial collation
or research.

 

However, we have identified a small number of formal documents or
‘memorandums’ that are readily retrievable and may provide further insight
into the DRP. We therefore invite you to clarify your request as follows:

 

•            Can I have a copy of the internal memorandums related to the
Dispute Resolution Process.

•            Can I also have a copy of all communication with the Minister
of Education or his representative, in regards to the service?

 

Please let us know if you are ok with the proposed clarification, or if

I am disappointed such an important project was not managed centrally. and did not have a project file.

I am happy to receive key memorandum and advice that is readily retrievable, or held centrally.

Can I also please have a copy of circulars that were made to the stakeholders providing information and advice re the dispute resolution process? For instance, did a circular go to relevant regional head offices, and schools.

Please also provide the list of all stakeholders (the consultation group) involved in the dispute resolution process? [Some were listed on the website but did not appear to be a complete list]
