Dear Ministry of Justice,

Please provide me with statistics of the:

1. number of requests for surrender received by the Minister of Justice pursuant to s18 of the Extradition Act 1999, broken down by year and extradition country; and

2. number of people surrendered under Part 3 of the Extradition Act 1999, broken down by year and extradition country;

2a. number of people not surrendered pursuant to each of the following sections: ss 30(2)(a), 30(2)(ab), 30(2)(b), 30(2)(c).
2b. number of people not surrendered pursuant to each of the following sections: ss 30(3)(a), 30(3)(b), 30(3)(c), 30(3)(d), 30(3)(e), and what the reasons were for 30(3)(e).
2c. the number of times, and details of any, undertakings sought by the Minister pursuant to s30(6) of the Extradition Act 1999.

3. number of people surrendered under Part 4 of the Extradition Act 1999, broken down by year and extradition country; and

4. number of people surrendered under Part 5 of the Extradition Act 1999, broken down by year and extradition country; and

5. number of people who the Minister of Justice has not surrendered under the Extradition Act 1999, broken down by year and extradition country; and

6. number of people discharged pursuant to s35 of the Extradition Act 1999; and

7. number of New Zealand citizens surrendered under the Extradition Act 1999, broken down by year and extradition country; and

8. number of cases referred to the Minister of Justice pursuant to s48 of the Extradition Act 1999; and the number of people surrendered pursuant to s49 of the Extradition Act 1999; and

9. number of people who have surrendered by consent, pursuant to s28 of the Extradition Act 1999, and the number of people who have surrendered by consent pursuant to s29 of the Extradition Act 1999; and

10. number of people who have surrendered by consent, under each of s28 and s53 of the Extradition Act 1999, broken down by year and extradition country.

Dear Cameron Stuart

 

Thank you for your email of 1 August 2014 requesting, under the Official
Information Act 1982 (the Act), statistical information about extradition
requests received by New Zealand.

 

You have asked for a range of statistics by reference to various
provisions of the Extradition Act 1999.  For the reasons that follow, we
ask that you refine your request.

 

The Ministry does not have a register of summary information about
completed extraditions.  New Zealand Police (Interpol office) does have
such a register, but advises that entries before 2010 may not be entirely
accurate.

 

We are able to answer your questions by cross referencing Police’s
register against our files for individual extraditions.  However, as you
will appreciate, this will be a time consuming exercise.  In particular,
some of your questions (especially 2a, 2b, 2c, 6, 7, and 8) relate to
matters that are not contained on Police’s register and will require
review of the relevant file.

 

We suggest refining your request to extradition requests from 2010 to the
present.  A preliminary assessment has identified approximately 30
requests to New Zealand for extradition of individuals during that
period.  Unless refined, it is likely that we will refuse your request on
the basis of substantial collation and research (section 18(f) of the
Act). 

 

Please also note that some of your questions relate to information held by
Police rather than the Ministry, but that we will co-ordinate a single
response in consultation with Police.
