I would like to request copies of:

1) All COVID-19 Weekly Situation Updates, dated since 29 August
2) The latest COVID-19 disease indicator national quarterly summary report
3) The post-exercise report and action plan for the scenario planning exercise undertaken with the National COVID-19 Laboratory Testing Network (referred to in your initial response)
4) A copy of the “Delta variant work programme” referred to in your initial response

Finally, I would like to request, for every weekly or fortnightly reporting period since the beginning of August, the values for each of the 13 COVID-19 disease summary indicators. I note that a document recently published on the Ministry website:

That you for updating me on the status of my request. I was surprised to hear that your response requires such a long extension though, as most of my request is for specific named documents that I wouldn't have thought would have been much trouble to locate.

Could you let me know what part of my request in particular requires the "substantial collation and research"? I can then consider rewording my request if it will make it any easier.

Dear Ministry of Health,

I'm emailing to follow up on part two of my 3 September request for copies of "all COVID-19 disease indicator summary reports, dated since the beginning of August."

In your response of 29 September I was told that this part of my request was refused under 18(d) as "the Ministry will publish a report containing this data within the next four weeks" and provided a link to the page on the Ministry website where it would be published.

When I followed up on 1 November you let me know that this proactive release was being delayed: "This information should be released within the next two weeks."

More than two weeks later, I would like to follow up on this again, as the information still hasn't been published on the Minsitry website. Can you provide me with a new release date?

I'd also like to let you know that the Ministry is close to the outer limit of what is considered "soon" for OIA refusals under 18(d). According to Ombudsman's guidance, as a general rule releases that occur more than 8 weeks after notification of the refusal cannot be considered "soon" for the purposes of 18(d). 8 weeks after your refusal is next Wednesday.

Dear Minsitry of Health,

Your reply does not include any response to the final part of my request. On 4 October I asked for:

Can you please let me know what happened to this part of your response?

Secondly, I'm not sure what you mean by saying that the information relevant to my request for a copy of the "latest COVID-19 disease indicator national quarterly summary report" is already publically available on the Ministry website. There are no quarterly reports published at the link you provided. In fact, nothing has been published here in more than 2 months.

The document "COVID-19 disease indicators specifications – effective 1 October 2021" available at that link states that:

"Changes to reporting frequency and report from August 2021 onwards include... National quarterly summary reports that provide a view of the impacts on the system of concurrent outbreaks, frequency of outbreaks, cases not confirmed as outbreaks, and Border Managed Isolation/Quarantine cases."

This is the sort of document I was referring to. By the time you received my request, there should have been a Q3 report completed. Can you please confirm whether or not any of these reports have actually been issued? If none exist, your response should have been 18(e).

Finally, as you may already be aware, I have referred your failure to provide any response to my 3 September request for "all COVID-19 disease indicator summary reports, dated since the beginning of August" to the Ombudsman for review. More than 3 months later, are you able to explain what has happened to these and when they will be released, either to me or on the Ministry website?

I'm suspicious that your very long delay providing any response to this request, and your failure to provide a response to the last part of my more recent request, are related: The Ministry is badly failing to meet it's contract tracing targets in the current outbreak, and wants to keep this fact from the public.

The Herald reports that they've also had to go to the Ombudsman for a request they made for contract tracing data. What else are you supposed to draw from this besides the Ministry have been trying to hide their underperformance from the public?

administrative error, this request was missed in your original request. We
apologise for any inconvenience this has caused. However, I have been

The Ministry is aware of an Ombudsman review (568964 refers) of the
response you received on 3 September 2021 for “all COVID-19 disease
indicator summary reports, dated since the beginning of August". The OIA
team was informed by the relevant directorate that these documents would
be uploaded to the Ministry website within four weeks.

 

The Ministry accepts and acknowledges there has been a failure to meet the
deadline to upload these documents on this occasion. The delay to upload
has been a result of significant capacity issues and we apologise for the
inconvenience or frustration caused to you as a result.

I'm suspicious that your very long delay providing any response to this
request, and your failure to provide a response to the last part of my
more recent request, are related: The Ministry is badly failing to meet
it's contract tracing targets in the current outbreak, and wants to keep
this fact from the public.

ONE: Copies of all COVID-19 Weekly Situation Updates, dated since 1 October 2021

TWO: A DPMC All-of-Government COVID-19 Daily Situation Report dated 6 October 2021 refers to “a full rapid review of COVID-19 medical devices and consumables within domestic supply… with a view to centralization under urgency” as being underway by the Ministry of Health at the time. I would like to request a copy of the review referred to here, and any action plan, implementation plan or work programme produced for implementing the recommendations of the review.

THREE: A letter dated 23 September 2021 between government advisor Sir Brian Roche and COVID-19 minister Chris Hipkins refers to a “full readiness assessment of the health system”:

“The current outbreak has revealed the very poor level of preparedness of hospitals for Delta. The system’s ability to deal with Delta and other business as usual functions of the health system has been found wanting. A full readiness assessment of the health system against agreed metrics for key preconditions should be part of the decision-making framework for phased reopening with a particular focus on workforce, diagnostic tools and infrastructure.”

Can you please let me know what happened to this part of your response?

 

Secondly, I'm not sure what you mean by saying that the information 
relevant to my request for a copy of the "latest COVID-19 disease 
indicator national quarterly summary report" is already publically 
available on the Ministry website. There are no quarterly reports 
published at the link you provided. In fact, nothing has been published 
here in more than 2 months.

 

The document "COVID-19 disease indicators specifications – effective 1 
October 2021" available at that link states that:

 

"Changes to reporting frequency and report from August 2021 onwards 
include... National quarterly summary reports that provide a view of the 
impacts on the system of concurrent outbreaks, frequency of outbreaks, 
cases not confirmed as outbreaks, and Border Managed Isolation/Quarantine 
cases."

 

This is the sort of document I was referring to. By the time you received 
my request, there should have been a Q3 report completed. Can you please 
confirm whether or not any of these reports have actually been issued? If 
none exist, your response should have been 18(e).

 

Finally, as you may already be aware, I have referred your failure to 
provide any response to my 3 September request for "all COVID-19 disease 
indicator summary reports, dated since the beginning of August" to the 
Ombudsman for review. More than 3 months later, are you able to explain 
what has happened to these and when they will be released, either to me
or  on the Ministry website?

Dear Ministry of Health,

What you have linked to is one specific CMSMG dashboard (for 1 April 2022). I asked for copies of all dashboards produced between 22 January and the date of my request (29 March). Your response of 22 February stated that the CMSMG meets fortnightly and a dashboard was "produced for each meeting". So what you have linked to is not in scope.

Please let me know when I can expect to receive copies of the in-scope dashboards. If in fact there is no fortnightly dashboard, or there were no dashboards produced within the period of my request, please let me know. As this request is already extremely delayed I would appreciate if you could do so promptly.

Thank you for your email. 

 

After discussing your request with the relevant subject matter experts,
the Ministry of Health can confirm the dashboard supplied in response to
your request is the only dashboard that was created near timeframe of your
request 22 January - 29 March 2022. 

 

For context, the first dashboard was created in August 2021 and as
mentioned previously, these were produced after each meeting through to
December 2021. 

 

While the CMSMG meetings continued in 2022, due to capacity restraints as
the team dealt with the Omicron outbreak, no dashboards were created
between January and March 2022. 

 

The first dashboard for 2022 was created on 1 April 2022 as the team's
workload stared to balance out and they had enough capacity to produce the
dashboards again. 

 

We trust this clarifies the response to your request. 

 

Under section 28(3) of the Act you have the right to ask the Ombudsman to
review any decisions made under this request. The Ombudsman may be
