Dear Jacinda Ardern,

New Zealand is a country of laws where no one is above the law irrespective of their position. I request under the Official Information Act what category the Prime Minister Jacinda Ardern came under to be eligible for vaccination. Additionally, I request under the Official Information Act what penalty, fine or punishment one would receive for providing false or misleading information to receive a Covid19 vaccination outside of their actual vaccination group.

This country has no "laws" on how the government provides vaccines to its citizens. It could decide to provide it in alphabetical order if it so chooses, (in which case the PM would be near the top of the list).

There is an ethical issue on members of parliament getting the jab before more vulnerable citizens but there is no breach of any statute.

It is likely that the orders on groupings/categories are enforced under either the COVID-19 Public Health Response Act 2020, the Health Act 1956 or some other emergency powers. Otherwise those guidelines are unenforceable and there is no penalty for individuals, GPs or District health boards completely ignoring them. In essence making those categories meaningless and meaning that the Government has inessence mislead the public as to each individuals eligibility.
