Disputes Tribunal

Mary Phillips made this Official Information request to Aupito William Sio

Response to this request is long overdue. By law Aupito William Sio should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Mary Phillips

Dear Aupito William Sio,

Please explain to me why when I purchase a service from a GST registered Incorporated Society they are able to convince the Disputes Tribunal that they cannot hear my dispute and I need to go to the High Court and seek Judicial Review.
If I purchase a service from a GST Registered trader who is not incorporated with the Inc Society the Disputes Tribunal can hear my dispute.

Yours faithfully,

Mary Phillips

Tribunal.

Your request was for the following:

"Why when I purchase a service from a GST registered Incorporated Society

dispute and I need to go to the High Court and seek Judicial Review. If I
purchase a service from a GST Registered trader who is not incorporated
with the Inc Society the Disputes Tribunal can hear my dispute."

because you are seeking an answer to a question as opposed to specific
documents and the Minister does not hold any official information in
response to this request. Therefore, your request has been refused under
section 18(g) of the OIA as the Minister does not hold this information
and there are no grounds for believing that the information is held by
another department, Minister of the Crown, organisation, or local
authority subject to the OIA.

You may like to speak with a lawyer to help explain these actions, and to
discuss any options available to you in these proceedings moving forward.
Free legal advice and information is available at your local Community Law
Centre or Citizens Advice Bureau. You can find your nearest centre at
communitylaw.org.nz or cab.org.nz

If you require any clarification of the information contained in this
response please contact Annaliese Wilson, Private Secretary (Justice) by

complain to the Ombudsman under section 28(3) of the OIA. You can contact
the Office of the Ombudsman by writing to PO Box 10152, Wellington 6143;
