I have checked and there is only document we hold regarding TVNZ's
decision to run advertising during coverage of the Tokyo 2020 Opening
Ceremony. This is an email between TVNZ and the Minister’s office
subsequent to the event which is withheld under s9(2)(g)(i) of the Act in
that it is free and frank advice.
By way of explanation, ad breaks during live sporting events are
implemented by production staff in our studio control rooms. While an
agreed number of breaks need to be scheduled to fulfil the relevant
agreements with advertisers, production staff have some flexibility on the
actual ad placement. There is no specific playbook on ad placement during
the ceremony.
As you have recognised the scheduled ad break screened too abruptly at the
end of the moment of silence during the TVNZ coverage of the Opening
Ceremony. This made it appear that we had played ads during the moment of
silence, and we would like to assure you that this was not the case. We
agree this moment should have been given a time to breathe and we
apologise for this.
In our view the withholding of the information is not outweighed by other
considerations which render it desirable in the public interest to make it
available. In accordance with Section 19(b) of the Act we advise that you
have the right to seek an investigation and review of the above refusal by
making a complaint under Section 28(3) to an Ombudsman.
