As you may be aware, section 12(1) of the Act grants the right to make requests under the Act to citizens or permanent residents of New Zealand, and those in New Zealand. On the basis of your request we are unable to confirm that you are eligible on these grounds. To allow us to progress your request further, we ask that you please provide us with suitable evidence of your eligibility. We are available to discuss this further if you wish; we can also give assurance that any evidence provided which might identify you will be kept in confidence. We would be grateful if you could come back to us on this soon, even if only to confirm that such evidence will be forthcoming, as this will allow us to commence processing your request and prevent the potential need for an extension of time in responding to you. We also note that your request is extremely broad and in its current form will be very difficult, if not impracticable, for us to provide. At this stage we would be likely to decline your request on the basis of 18(f) of the Act as it will require substantial research and collation. Would it be possible to clarify and/or limit the scope of your request to make the request practically manageable. We can provide you with a copy of the ethics application and approval and documents in relation to the ethics application. Would that suffice?

We refer to your information request dated 22 July 2021 made under the Official Information Act 1982 (Act) in relation to the "DentalSlim Diet Control Device".

You have requested "any and all materials, research, and correspondence concerning the DentalSlim Diet Control Device". You have also asked for "all internal correspondence and research materials from the University, and any external correspondence from the University and its members to any outside research facilities, media outlets, government entities, or any other institutions or members of the general public" in relation to the Device.

We emailed you 27 July 2021 to seek clarification of your eligibility to make a request under the Act, and to query whether you would be willing to limit the scope of your request. At the time we advised that the request in its original form was very broad and would be very difficult, if not impracticable, for us to provide you with the information.

We note that we have not heard back from you. Accordingly, we need to refuse your request because the scope of your request remains extremely broad and would require substantial staff time to research and collate. Our decision is made pursuant to section 18(f) of the Act on the basis that the information requested cannot be made available without substantial collation or research.

We note your right to see a review of this decision via a complaint to an Ombudsman. However, we would welcome the opportunity to discuss any concerns with you first.
