Value of Unlock Projects, and Share of Value from Unlock Projects

Dear Panuku Development Auckland Limited,
This LGOIMA request concerns the total economic value that Panuku has unlocked through each of your Unlock Projects since Panuku was established, and how this value has been shared.
Therefore, for each of your Unlock Projects, please advise:
1) The owner(s) of the land at the beginning of the project and at its completion (or as at today's date for projects that are not completed);
2) The property development company or companies involved in the project (such as Avanda, Fletcher, Malaysian Resources Corporation Berhad, McConnell, Ockham, Precinct, RCP, Willis Bond and similar companies), whether or not their involvement was directly facilitated by Panuku, or is just known to Panuku;
3) The total economic value unlocked or expected to be unlocked by the project; and
4) The percentage of the value from 3 above that has been or is expected to be shared by:
(i) the land owners from 1 above;
(ii) each of the property development companies from 2 above;
(iii) employees of and subcontractors to those property development companies;
(iv) tenants of completed projects;
(v) new homeowners;
(vi) Auckland Council and Panuku (on behalf of ratepayers); and
(vii) the general public, including as consumers of amenity value.
I understand and accept that some of the values in 3 and 4 above may necessarily be fairly rough estimates. Please also advise who generated these estimates and when.

Thank you for your letter of 21 June.
Your letter does not meet your obligations under the Official Information Act, as follows:
1) My request was for "[t]he owner(s) of the land at the beginning of the project and at its completion (or as at today's date for projects that are not completed". You have indicated all land at the beginning of each project was owned by Auckland Council. You have not provided information on who owns the land at completion, or at 2 June 2021. Please provide this information that you hold.

3) Your answer indicates that Panuku holds information about how how it “unlocks” value within town centres, given its staff are able to brief me on this. However, I wish to be transparent and for the information to be provided as requested, through fyi.org.nz. You will be aware that, for the purposes of the OIA and LGOIMA,“information” includes all written documents but has also been defined more broadly by the Court of Appeal and by the Ombudsman (see Ombudsman’s Quarterly Update, Vol 4, Issue 3, Sept 1998) as including not only the written word but any knowledge, however gained or held, by Panuku, and therefore includes knowledge in the minds of Panuku employees, board members and consultants that has not otherwise been recorded in documentary form. Therefore could you please provide me with this information in writing. To reduce the work involved, could you please limit this to Unlock Hobsonville, Unlock Henderson and Unlock Avondale at this stage.
4) I shall await your response to 3 above before considering next steps with this request.

Thank you for explaining your concerns about our response to your official
information request. We have discussed these concerns with Eke Panuku,
who, while they stand by their responses to your questions, have agreed to
provide further information and documentation which will provide you with
more context and explanation about the Unlock Projects.
It will however take some time to collate this information and so we are
extending the timeframe to respond under section 14 of the Local
Government Official Information and Meetings Act 1987 to 14 July.
