Ministry of Business, Innovation & Employment
Dear Mr Wang
I was allocated your request to process and have been obtaining
documentation in scope of your request. However, to ensure that I provide
the correct ifnromation, I do have a question to determine exactly what
you are actually wanting.
Your request was for:
I am a New Zealand Citizen. I am writing to kindly request a copy of the
most recent instruction manual Immigration Officers follow to assess CPVV
applications for Other Critical Workers to New Zealand (including a more
detailed explanation of the terms "unique experience and technical or
specialist skills" and "not readily obtainable").
· You are requesting information about the assessment of the
Critical Purpose Visitor Visa (CPVV) application with reference to one of
the specific criterion that defines ‘other critical worker’ in the
immigration instructions (H5.30.5(a)(i)).
o This reference to the instructions suggests that you are in fact after
the information in regards to the assessment of the Approval in Principle
(H5.15) request submitted by employers for border exceptions, before the
identified individuals are invited to apply for a CPVV? The submissions
by the employers must contain documentation as to how the individuals meet
the ‘Other Critical worker’ definitions the assessment as to whether the
workers requested meet the relevant criteria (H5.30.5).
If this is correct, then I will amend your request to be for:
· The most recent instruction manual Immigration Officers follow to
assess the approval in principle requests for Other Critical Workers to
New Zealand (including a more detailed explanation of the terms "unique
experience and technical or specialist skills" and "not readily
obtainable").
Please confirm if this is correct?
Also, you have stated that you are a NZ citizen and as such are able to
make a request under the section 12 of the Official Information Act.
Could you please provide the documentation to support this for our
records, i.e. a copy of your NZ passport?
I will wait for your response and documentation before I continue
processing your request.
Regards
Penny Hazlett
