Dear Ministry of Education,

 

As a New Zealand born citizen. I hereby request the following information,
pursuant to the Offical Information Act.

 

It is my understanding and is it not true that the Human Rights, as
documented in the 1948 Declaration of Human Rights, Proclaimed and Adopted
by the General Assembly resolution 217 A (III) of 10 December 1948, that
in 1976 became International Law, and was reaffirmed in as such in 1998,
are the absolute Rights of every Man and Woman of the Human family, and
the Government of New Zealand in 1948 ratified and became signatories to
said Declaration and are thus bound by International Law to its words and
intent.

 

Article 1. 

All human beings are born free and equal in dignity and rights.  They are
endowed with reason and conscience and should act towards one another in a
spirit of brotherhood.

 

Article 26. 

(1) Everyone has the right to education. Education shall be free, at least
in the elementary and fundamental stages. Elementary education shall be
compulsory. Technical and professional education shall be made generally
available and higher education shall be equally accessible to all on the
basis of merit.

(2) Education shall be directed to the full development of the human
personality and to the strengthening of respect for human rights and
fundamental freedoms. It shall promote understanding, tolerance and
friendship among all nations, racial or religious groups, and shall
further the activities of the United Nations for the maintenance of peace.

(3) Parents have a prior right to choose the kind of education that shall
be given to their children.

 

My question for information is:

 

1. It is my understanding and is it not true that fundamental degrees that
benefit our society should be free for all New Zealanders and can not be
charged for, levied or liened in any way shape or form.

 

2. That any and all contribution New Zealanders may make from this day
forth is entirely voluntary, and not to be seen as an obligation in any
way shape or form. Thus all consideration made to date has been made
without full disclosure and thus any agreement is void ab intio (from the
inception), is potentially fraud, and all consideration needs be returned
to the people.

 

If this is not your understanding then please help to resolve this
situation by providing your lawful documented authority to charge New
Zealanders and place our people in debt bondage. 

 

If no lawfully documented live signed point by point rebuttal is received
by me at my address for service within the time frame of thirsty (30) days
then my understanding prevails in Truth and Law. 

 

Let any whom make claim upon me state and Lawfully substantiate their
claim or for ever hold the peace.

Thank you for your email of 26 June requesting information under the
Official Information Act about the authority for charging tuition fees for
degrees and student loan repayment obligations.

The New Zealand Government aims to make tertiary education equally
accessible to all New Zealanders. 

 

In New Zealand, as is the case in many countries, the costs of tertiary
education are shared between Government, students and their families. Cost
sharing recognises that tertiary education has a benefit to New Zealand
and to the individual.

 

The Student Loan Scheme helps the Government maintain high levels of
access to tertiary education while managing the high costs this places on
the Government.  Student allowances provide non-repayable grants to
full-time students from low income backgrounds to help with their living
costs in order to reduce financial barriers to tertiary education.

 

The Government also makes tertiary education accessible by meeting around
76 percent of the costs of tuition.  This includes though tuition
subsidies and fee subsidies (e.g. fees-free for new entrants and
foundation level study). Because much of a student’s share is met by
discounted interest free borrowing through the Student Loan Scheme to pay
for fees, the Government’s contribution increases to around 86 percent of
the costs of tuition.

 

You have asked about the authority for charging fees to New Zealanders for
tertiary education and for student loans. Under the Education Act 1989
section 227, a council of a public institution can set domestic fees for a
programme of study or training. The enrolment agreement is a contract that
is signed between the student and tertiary provider.

 

The student loan eligibility rules are set out in the decisions of Cabinet
recorded as Cabinet Minutes. Access to a loan is provided through contract
between the Crown and the student. The collection rules for student loans
are set out in the Student Loan Scheme Act 2011.
