Dear Mrs Benincasa

Shortly after I responded to your Official Information Act request the
Overseas Investment Office (OIO) did receive an application from Microsoft
New Zealand Limited (Microsoft) to build a regional data centre in New
Zealand.

Microsoft’s application is currently being assessed as part of the OIO’s
standard quality assurance process to make sure that they have provided
all the information that is necessary for the OIO to process the
application.

The following link to our website explains the assessment process that the
OIO generally follows for all applications including Microsoft’s.

You may be interested that while the OIO isn’t required to consult on
applications, the OIO does accept submissions from people and
organisations (third parties) on applications that it has received or may
receive in the future. The following link to our website sets out how you
can make a submission and what happens to any submission that you may wish
to make

In relation to Microsoft’s application;

·       We do not know when a decision will be made; and

·       All other information relating to the application remains
confidential at least until such time as a decision has been made.

I hope the above provides you with an understanding of the application
processes operated by the OIO.

Regards
