Dear Ministry Of Business, Innovation & Employment,

I would like to request following information under the Official Information Act (OIA).

(1) What law or legal rights allows the Companies Office to provide company contact information such as phone number of a company's directors or shareholders to a third party for the use of direct marketing by that third party for that third party(s) benefit not for the benefit of MBIE or Company Office. If there is any such legal framework, please include the details of any program(s) that allows companies office to do so. A friend of mine received a phone call from a company offering their services for a recently incorporated company. The company caller clearly stated that they've became aware of the newly incorporated company and would he be interested in their products and services. It's impossible as to how any person is able to search for companies by their incorporation date. I'm not aware of any such public search facility. Hence, it leads me to conclude that there exists other elaborate company record search facility (computerized or otherwise) other than the one available at http://business.govt.nz/companies or information about newly incorporated company is provided by Companies office to a third party for it's commercial use.

(2) What procedures and/or policies are in place to ensure public record of companies is not used for marketing purposes by commercial entities and what procedures and/or policies are in place to deter commercial entity from data mining through internet or other form for their marketing purposes. It came to my attention that phone number and email of person who filled-out director and shareholder consent form are located in bottom of the consent form. The contact information gets automatically filled in with the details of the person who registered the company through companies office website. Is it legally required to include that information on every form? If required what information exactly is required? Can that information be blanked out from public view if legally possible?

If you don't resend your response to correct OIA request that request will be classified as "Long Overdue". I don't think I will be able to change the status of that OIA request through fyi.org.nz.
