Dear Rosie Jansen,
I received a surprise when I saw the 70 files I'm expected to download. They constitute a data dump. I'm at a loss to why I have paid $532.00 for a service that's given me little or any added value. I have explicitly asked for a catalog of tree consents and tree numbers since the RMA in 2012 not a pile of consents.
Your good cousins in Auckland provided 3,000 catalogued records available for free to the Tree council. Why can't you do the same?
The OIA mentions that 'an agency cannot charge for if the time to respond to a request is caused by its own inefficiency or poor record keeping.'
I would therefore like a full refund.

As mentioned in Matt Weavers' letter to you dated 5 July 2019 (attached), we proposed that we would provide the requested information by retrieving planning notices of decisions (NODs), collate and send to you. Your response on 17 July 2019 and subsequent payment was deemed agreement so we undertook this work as set out in the letter. We provided you with this information on 2 August 2019.
We recognise that you had originally requested a catalogue however under section 17(g) of the Local Government Official Information and Meetings Act, we are not required to create a document that did not already exist which is why we proposed providing the raw information. I received a surprise when I saw the 70 files I'm expected to download. They constitute a data dump. I'm at a loss to why I have paid $532.00 for a service that's given me little or any added value. I have explicitly asked for a catalog of tree consents and tree numbers since the RMA in 2012 not a pile of consents.
Your good cousins in Auckland provided 3,000 catalogued records available for free to the Tree council. Why can't you do the same?
The OIA mentions that 'an agency cannot charge for if the time to respond to a request is caused by its own inefficiency or poor record keeping.'
I would therefore like a full refund.

Just to clarify, your username should be [FOI #10583 email], and the password set by you (I note you have done this from your email to Accellion).
I have run a test to access the folder in the same way that you were invited and this has worked for me. I have invited your personal email to the folder on Kiteworks to see if the problem is the FYI email address. Please see instructions below.
1. Follow the 'Access folder' link in the email from Kiteworks titled : '[email address] shared the "LGOIMA 994" folder with you'
2. Select 'Create account' - use the email address [email address] as the username and create your password
3. Use your newly created username and password to sign in and access the folder - this should take you directly to the folder

As mentioned in Matt Weavers' letter to you dated 5 July 2019 (attached), we proposed that we would provide the requested information by retrieving planning notices of decisions (NODs), collate and send to you. Your response on 17 July 2019 and subsequent payment was deemed agreement so we undertook this work as set out in the letter. We provided you with this information on 2 August 2019.
We recognise that you had originally requested a catalogue however under section 17(g) of the Local Government Official Information and Meetings Act, we are not required to create a document that did not already exist which is why we proposed providing the raw information.
