Request for Information

 

I refer to your correspondence dated 12/04/2019 in which you requested "I
would like to request the following case summaries: 190317/2019,
190213/6528 & 190220/1431".
 
I have considered your request in accordance with the Official Information
Act 1982.   I enclose a copy of some of the requested information.   Some
information has been withheld pursuant to sections:

* Section 6(c) to avoid prejudice of the maintenance of the law,
including the prevention, investigation and detection of offences, and
the right to a fair trial;
* Section 9(2)(a) to protect the privacy of natural persons, including
that of deceased natural persons.

 

File number 190317/2019   This is not an active police file number.
File number 190213/6528   This matter is still under investigation, and
the release of related information is refused at this time in accordance
with Section 6(c) of the Act as described above.
File number 190220/1431   This matter has been released in full. 
 
 
If you are not satisfied with my response to your request you have the
right to complain to the Office of the Ombudsman and seek an investigation
and review of my decision.

Dear New Zealand Police,

Hi Barry,

I actually used file number 190317/2019 from your official response at https://fyi.org.nz/request/9856-requesti.... "This matter is still under investigation, for future reference the related police file number is 190317/2019."

As I was going off your information, can you please inform me of the correct file number, and just provide it as I requested. I would prefer not to wait yet another 20 days due to your incorrect information supplied. Perhaps have some QA process to ensure only correct information is released.

The case was about a bus running a red light. I filed in over a month ago. I would expect that this is no longer "under active investigation", but given the Police's track record, I would not be surprised if it is...

The details are:
Vehicle: Metlink bus route 52
Location: Willis St by Chews Lane
Date: 25 Jan 2019
Time: 9:41am

This was reported by myself, at around 2:30pm 14th March 2019 at Wellington Central Station.

As for file 190213/6528, this was reported nearly 3 months ago, and I highly doubt that this is "still under investigation". Can I please request the dates of all correspondence on that file. If the correspondence is simply me requesting the file, please ignore that. The purpose of this request is to determine when the Police were actually last "investigating" this. If there is no recent dates of correspondence on this file, I would like it to be requested in full, and not refused due to being "under investigation", as if there are no recent entries, it is not under investigation, the Police have simply chosen not to bother to pursue it.

Dear New Zealand Police,

Hi Barry,

Further on file 190213/6528, I did a privacy act request on all files reported by me, to which *you* responded on 12th March 2019, and included the file as it was then. The file showed only my original complaint and no Police action. The purpose of me requesting these files is to determine what Police action is taken if any. From what I can gather, there was no action taken in the month from 5th Feb 2019 til 12th March 2019, and I highly doubt that there has been action since. This is what I would like to confirm. The Police are making this highly difficult for me to confirm. Either the Police have acted (which it is shown that they didn't do anything after a month), or they have not. If they have not acted, then the file is far from "under investigation". It really seems like you are illegally refusing requests under the OIA as it shows that the Police are not performing to standard.

I also find it incredibly interesting that you refused the file under s6(c) of the OIA, but were more than happy to provide it under a Privacy Act request. If it is so sensitive that you can't release it under the OIA, how come you can under the Privacy Act? Should I make a new privacy act request for that file and just get it? Is this how the Police treats OIA requests normally?
