Dear Bay of Plenty District Health Board
1) I request all copies of communications to and from CEO Helen Mason with respect to the DHB/NZNO Union negotiations which were sent/received from 1 April 2018 to the date of this request.
2) I request all copies of communications messages (Comms messages), key messages, or media messages (including all draft versions) prepared in relation to the media release containing the DHBs revised offer to NZNO which took place on or around 28 May 2018. This includes any accompanying emails or memos which were sent relating this these.
3) I request all correspondence or documents held which refer to the potential for nurses to earn $93,000 under the revised offer, as reported in the media on or around 28 May 2018.
Please note that there should be no reason to withhold this information pursuant to section 9 of the Official Information Act, as the DHB already widely distributed its revised offer to the media. I would also like this request to be treated with urgency as there is a strong public interest & need for transparency around the DHB decision-making process with respect to how it has announced this offer.

Please find below response to your Official Information Act request dated
31 May 2017:
We have received your request under the Official Information Act 1982 (the
Act) for the following information:
1) I request all copies of communications to and from CEO Helen Mason with
respect to the DHB/NZNO Union negotiations which were sent/received from 1
April 2018 to the date of this request.
2) I request all copies of communications messages (Comms messages), key
messages, or media messages (including all draft versions) prepared in
relation to the media release containing the DHBs revised offer to NZNO
which took place on or around 28 May 2018. This includes any accompanying
emails or memos which were sent relating this these.
3) I request all correspondence or documents held which refer to the

Bay of Plenty DHB has some of the information requested which we will
compile. Question 2 and 3 but we believe the information is more closely
connected with the functions of TAS and so we are transferring the request
to them under section 14 of the Act.

Dear Diana Marriott,
I never received a response from TAS and Ms Martin has not responded to my latest query either. I'm reluctant to make a complaint to the Ombudsman but this is so long overdue, with no contact from anyone in such a long time I don't think I have any choice. Could you please flag this to TAS urgently?
If I don't have a response shortly I will be complaining to the Ombudsman.

Dear Cherie Martin
Sorry to bother you again but I want to double-check. I can't seem to locate TAS under schedule 1 of the OIA so I'm not sure if a transfer to TAS is valid under the Act? If TAS is acting on behalf of the DHB but itself not subject to the Act then the DHB would be deemed to hold the information?
I might be mistaken about the status of TAS but wanted to check in on that.
If TAS is subject to the Act as a department or organisation under schedule 1, could you please send a reminder to them? The email addresses are obscured on the FYI website so I can no longer message them.

Yes TAS does respond to relevant OIA requests (i.e. requests which TSA holds information for and may answer, noting that some OIA requests can only be partially answered by TAS) on behalf of DHBs and DHBs may transfer OIA requests to TAS.
