Your review along with your parliamentary of Section 70, Social Security Act 1964 along with Ruth Dyson.

Robert Newcombe made this Official Information request to Jacinda Ardern

The request was partially successful.

From: Robert Newcombe

Dear Prime Minister Ardern,

Before and since coming to power you profess to hold equality and fairness for all as your ideals.
Over the years the loss of overseas government contributory social insurance pensions to the rule of Section 70 has been proved to be unfair and discriminatory by reviews carried out by the MSD and the Retirement Policy and Research Centre Auckland University on behalf of the Human Rights Commission.

I along with others need to know whether you regard Section 70 as morally fair and in line with human rights and whether the 90,000 of us elderly affected by Section 70 have no right to receive these pensions that have been paid for out of earnings along with contributions from employers.

Under OIA could you please supply a copy of the work you did on this proven injustice along with your colleague Ruth Dyson.

Yours sincerely,

Robert Newcombe.

From: Robert Newcombe

Dear Rt. Hon Jacinda Ardern,

I along with approximately 90,00 other elderly are impoverished by the application of Section 70, Social Security Act 1964 by having my contributed self funded (through social security contributions from both me and my employers) United Kingdom State pension deducted from my separate entitlement to govt funded universal NZ Superannuation.
There are around 60,000 UK State pensioners affected.
Despite MSD, HRC, RPRC, reviews condemning this application of S70 tto these type of overseas pensions, (but not Chinese state pensions) as unfair and discriminatory, nothing has been done to end this injustice.
The Labour Party recognised this and had change in their manifesto and as a member of the Labour Party I recorded for evidence Grant Robertson and David Cunliffe both replying to my question "What would you do if you became Labour leader about the loss off these overseas pensions" and both said they had been approached many times by constituents and it needed sorting yet they too have remained like you, silent.
You and your govt have made great play on equality and fairness yet you have said and done nothing about this injustice.
Winston Peters has campaigned for years about the unfairness of Section 70 and promised change and once in power has turned his back on those of us who voted on his lies.
Another time wasting still revenue collecting revue is not needed the evidence is overwhelming.
In 2014 15 of us elderly took the govt to the United Nations Human Rights Council where crown law produced a response that was nothing more than a pack of lies to defeat us, which goes to show the govt knew it was in the wrong.
I could go on but all I need to know is are you or are you not going to end this human rights abuse against us elderly?

Your sincerely, ,

Robert Newcombe

Dear Jacinda Ardern,

A view of silence has been thrown over Carmel Sepuloni's office, she has not replied to any references in fact there are several in our group who have tried to contact her and she has not replied, gone to ground as you might say.
My request to you was not about a reply through her office but a request for a copy of the work you did with Ruth Dyson on the injustice of Section 70.
I am a Labour Party member as well as a Section 70 victim and I was briefed by the party that you had indeed worked together.
You know very well all about this appalling state abuse of us elderly and so once again I request a copy of the work you did with Ruth Dyson on Section 70 and it's effects.
You know very well about Section 70 as you were the Labour representative on the 2012 Select Committee on Social Development and along with the Greens and NZ1ST called for a review of Section 70 which was over ruled.
Since coming to power your words of equality and fairness values are empty with no feelings for the 89,000 victims affected.
On March 5 there is a case in the Human Rights Review Tribunal when 3 sets of victims challenge the spousal agreement of Section 70, you might just want to keep your eyes on that because it will be made public.

Please stop beating about the bush trying to dodge the inevitable and provide me with the information I seek.

Yours faithfully,

Robert Newcombe

The response was just the findings of the chairman of the 2012 Select Committee when the National members outvoted the Greens, Labour NZ1st members over their request that Section 70 be investigated.
It was just another time wasting select committe designed to fool the public into thinking we live in a democracy and which I have known of for years.
It's resurrection is just another smoke screen designed side step the real request.
The three party anti Section 70 representatives included the now PM who as per norm now in power suffers from brain fade perhaps brought on by an ever enlarging bump which has taken priority in the nation's life.
In her role as celebrity PM, fashion model for vogue and an advert for maternity clothes, we as citizens might just as well stick our heads between our legs and kiss democracy good bye, in fact why bother its too late, we don't live in a democracy, parliament is supreme over the Bill of Rights, the country should be officially renamed as Aotearort..
National had its smiling assassin, Labour now has its equivalent, Ardern.
Please excuse me as I stick my fingers down my throat.

Bob Newcombe,
just 1 of 90,000 Section 70 victims and of course fools who believed the leader of the Winston 1st Forever Party the Honorable up yours Winston, sunning himself somewhere nice with his officially paid bottomless booze lying quietly by his side.
Don't you just love New Zealand politics, our country with just one day of democracy when every 3 years we get to vote the next bunch of self serving morons to rule over us.

Dear Rt. Hon Jacinda Ardern,

Pre election you promised equality and fairness, the rights of the child are paramount, yes they are but the rights of us elderly Section 70 victims have been kicked into touch.
You have the distinction now of being the youngest Prime Minister to continue this crime against humanity.
History will record yourself and Winston Peterms as false prophets whose god is money.
MP's Superannuation is golden, for every dollar you pay you get $2.50 back 250% growth and for every $1 we receive from our overseas govt paid incomes we lose t$ that's 100% loss, our monies go towards your greedy MPs pension plans..

Yours sincerely,

Dear Jacinda Ardern,
I would really like you to reply to my request, you are aware of this injustice and have chosen to ignore what is a crime against us elderly
I can promise you and Winston Peters that you will not enjoy this coming year, we aim to out you two as con artists, abusers of us elderly who promised change and then continued plundering our pensions.
You may come across to the gullible public as nice and caring but we Section 70 victims know different.
You will be taken before the UNHRC but unlike the last time we challenged the rort at the UNHRC we are better prepared and will be using the National govt's response in which it had to lie to defeat us as proof.

Yours faithfully,

Robert Newcombe

Robert,

For now I will not remove this request, but I do wish to reiterate our policy and ask that you exercise caution in your wording of requests and follow-ups in future. Specifically, you should only request official information and only include such background information as required for the authority to locate that information.

FYI.org.nz must not be used to make allegations, make any kind of threat, or to harass. Such communications may not be lawful and thus threaten the survival of this service.

Regardless of how important an issue or how passionate the requester, this is also not the appropriate place to engage in political lobbying or arguments about a cause. If a request has been unsuccessful, the correct avenue is a complaint to the Ombudsman. Ongoing back-and-forth following a refusal reduces the overall effectiveness of requests made through FYI.org.nz.

Please read the section "Why must I keep my request focused?" here: https://fyi.org.nz/help/requesting#focused

Dear Lenz,

What you don't seem to understand is that these are not accusations without foundation but the truth.
.Ardern and Peters are both fully aware of the unfair nature of Section 70, indeed Ardern called it a "violation of human rights" in parliament in 2015.
Peters forced the 2005 MSD review of Section 70 when in coalition with Labour and ignored the damning results.
Pre this election both promised change but now in power the continuing impoverishment of us elderly continues and you moan about me fighting for justice.
Perhaps if the Herald were to publish these FYIs more would be done but your paper is patheticly toothless, as much to blame for the continuing injustice by its silence over this appalling injustice as are the two faced lying politicians who pursue it.
New Zealand's media is gutless, tthis human rights abuse of us elderly is not deemed important at all that is until your staff suddenly realise we are right and demand action.

Yours sincerely,

Robert Newcombe
