Aaron W made this Official Information request to David Seymour

This request has an unknown status. We're waiting for Aaron W to read recent responses and update the status.

From: Aaron W

Dear David Seymour,

Please provide all information relating to your response to my earlier request: https://fyi.org.nz/request/34655-informa....

Please also provide all information (including correspondence) in relation this event (the event announcing the solar power regulations review).

I have been advised by the Ombudsman that your initial response was incorrect (you refused under the reasoning that 'any information was held by the ACT party'). Your office subsequently advised that this was actually held by the host of the event.

This is now the second request that I have had with your Office that you've subsequently admitted you've gotten wrong (I am still waiting for a resolution on the earlier request despite being made months ago- I'd be happy to receive that anytime by the way).

Given the recent confirmation of the Prime Minister's Office refusing a request as the information 'doesn't exist' (which is turned out it did), I am making this request to understand your processes as to how you came to a decision on my earlier request which will help me to understand how you got this wrong.

Yours faithfully,

Aaron W

From: Aaron W

Dear David Seymour (MIN),

Is your office saying that in relation to a single event (which happened very recently) and a single request (that being information relating to my earlier request) is too much work? A reminder that this request was also made and responded to very recently so the information requested clearly hasn't been archived or anything like that.

I am asking for:
-Information relating to the Solar regulations review event (not the wider solar industry review, just the event) and;
-Information relating to my previous request (essentially, I want to understand how, once again, your office has 'mistakenly' made a decision on one of my requests). Not any other requests, just this one request.

I would like your Office to explanation why it believes that 18(f) applies here. Particularly as I would assume your office would hold filing systems in relation to responding to OIA requests. Therefore, at least one part should be very easy to respond to. You are also required to provide reasonable assistance. I would consider explaining why you cannot respond to my request as it is currently worded to be reasonable.

I would also like to note that according to the Ombudsman, administrative failings are not a reason to refuse under section 18(f) of the OIA. Therefore, if your office has not undertaken good filing practices, then please do not refuse on those grounds.

Finally, I would again welcome a reply to the questions I have posed on an earlier request re: Regulatory Standards Review. I have been waiting over 18 months.

Yours sincerely,

Aaron W
