Please provide any details relating to the assessments used to determine whether financially unviable airlines are allowed to continue operating an AOC in New Zealand.
A large freight operator in New Zealand has been in Receivership for almost 9 months now, no buyers on the horizon due, rumour has it, to the poor quality of their aircraft records. Have any discussions been had internally regarding its ongoing viability and the risk to New Zealand aviation to allow them to continue to operate?

We are writing in relation to your recent request for information under
the Official Information Act 1982.

 

We have assessed your request but are seeking clarification, as it is not
currently clear what specific information you are requesting. Section
12(2) of the Act requires that a request specify the official information
sought with due particularity, and we have a duty to assist you to clarify
or refine your request where appropriate.

 

In your request, you refer to:

 

o the assessments used to determine whether financially unviable
airlines are permitted to continue operating an Air Operator
Certificate (AOC) in New Zealand; and
o reports or discussions concerning a large New Zealand freight operator
that has been in receivership for an extended period, including any
internal consideration of its ongoing viability or aviation safety
risk.

 

To assist us in responding appropriately, could you please clarify:

o whether you are seeking copies of specific documents
o whether your request relates to CAA’s general regulatory framework and
assessment criteria, or to consideration of a particular operator

 

Once we receive clarification, we will be better placed to determine the
scope of your request and to respond in accordance with the Act.

 

Please note that the statutory timeframe for responding to your request
will be paused until clarification is received.

Thanks for your response.

In clarification please provide the following:

A copy of CAA's guidelines into assessment of financially unviable airlines
Any internal documentation/reports as to whether Airwork Flight Operations Limited should receive any exemptions under those guidelines whilst it is in Receivership.
Any internal documentation/reports/correspondence as to what CAA is doing to ensure that Airwork Flight Operations Limited is capable of maintaining adequate safety standards whilst in Receivership.
Any internal documentation/reports/correspondence on the suspension/deferral of scheduled audit work on Airwork Flight Operations Limited, and whether this includes acknowledgement that Airwork Flight Operations Limited has suspended its internal safety audits of offshore bases due to financial considerations.

In addition I would like to have any documentation to confirm whether CAA has investigated Airwork Flight Operations Limited's record keeping, given that they have been unable to return a leased aircraft due to poor record keeping whilst it was operated on lease to them.
