Justification for failing to enforce bylaw breach deadline.

Dear Waitaki District Council,

Attention Andrew Bardsley,
rooster complaint lodged 25/07/2024:

Our neighbour was given the deadline of August 8th to re-home their rooster as it was in breach of Waitaki General Bylaw (56).

On the day of the deadline, 8th August, council informed me that the deadline to re-home the rooster was no longer relevant as part 56 of the General Bylaw no longer applied, because the owner of the rooster had joined a recognised Poultry, Pigeon & Cage Bird Association, as stipulated in part 57 of the General Bylaw.

Due to the above, I asked council to please provide me a copy of the documentation/ evidence that had been provided by my neighbour as proof of membership in the Poultry, Pigeon & Cage Bird Association.

Council replied, that the owner of the rooster had provided council with the relevant evidence, that they were a member of the Poultry, Pigeon & Cage Bird Association, and that council cannot provide me with a copy of this, due to privacy considerations.

If council had in fact received proof of membership, prior to the 8th August deadline, why was my neighbour still petitioning the Poultry, Pigeon & Cage Bird Association for membership, as of 7pm on the 8th August,(documentation available on request)?

Once again I would like to request that council be open and transparent and provide the evidence received from my neighbour as proof of membership, if it exists thanks?

I would like to request that council be open and transparent and provide
the evidence received from my neighbour as proof of membership, if it
exists thanks?

 

Council Officers have reviewed your request and have collated the answers
in red and attached one image and one pdf.

 

We have asked the owner of the offending rooster if she is prepared to
grant us permission to share her proof of membership of the Oamaru
Poultry, Pigeon & Canary Society with the requester. 

The attached document includes her written permission, and a copy of her
membership card is also attached.

 

You have the right to seek an investigation and review by the Ombudsman.
