Official information request for information regarding Central Banks
Digital

Thank you for your official information request of 21/12/2023 for:

 

"All advice/memos/reports/communications between Prime Minister and/or
Cabinet and the Minister of Finance (or acting Minister of Finance) which
refer to or discuss central bank digital currencies (CBDCs). From March
2022 – December 16 2023."

 

We will endeavour to respond to your request as soon as possible and in
any event no later than 12/02/2024, being 20 working days after the day of
your request. If we are unable to respond to your request by then, we will
notify you of an extension of that timeframe.

 

Charges for providing official information and publishing responses

The Official Information Act allows charges to be imposed for the
preparation of information that we send in response to requests. The
Reserve Bank is resourced to meet disclosure obligations for a reasonable
level of requests and generally will not impose charges for small, simple
or infrequent requests. Where the request is for information that requires
substantial collation, research and preparation work, and is chargeable,
we will work with you first to refine the request to a smaller scale or
scope that is less likely to involve charges.

 

Responses to official information requests are published on the Reserve
Bank’s website. We will confirm in our decision letter to you whether we
intend to publish our response to your request.

Thank you for your email dated 22 December 2023 asking the Department of
the Prime Minister and Cabinet (DPMC) to cancel the transfer of your
request received under the Official Information Act (Act) to the Reserve
Bank of New Zealand.

 

The Act provides that if an agency believes that the requested information
is held by another agency or is more closely connected to the functions of
another agency then the agency shall transfer the request to the relevant
agency.

 

For your request, matters relating to Central Bank Digital Currencies do
not sit with DPMC portfolios. DPMC assessed your request and determined
that the Reserve Bank is the appropriate agency to response to your
request.

 

We reiterate our decision to transfer of your request to the Reserve Bank
under section 14(b)(ii) of the Act.

Good afternoon Jodie

I am contacting you about your OIA request we have had transferred from
DPMC for: All advice/memos/reports/communications between Prime Minister
and/or Cabinet and the Minister of Finance (or acting Minister of Finance)
which refer to or discuss central bank digital currencies (CBDCs). From
March 2022 – December 16 2023.

 

When a new government takes office the papers of former ministers are
returned to the originating agencies, who will then deal with any OIAs
addressed to or aligned with the functions of former government ministers.

 

RBNZ has  conducted a search of our records and it appears we do not hold
anything in respect of advice or other documents sent to/returned from the
former Minister of Finance that would fall within scope of your request.
Therefore, we will likely refuse the part of your request relating to
advice/memos/reports on the grounds that the information does not exist or
cannot be found.

 

Regarding the part of your request for “communications between Prime
Minister and/or Cabinet and the Minister of Finance (or acting Minister of
Finance) which refer to or discuss central bank digital currencies
(CBDCs)”, there is a process for searching through the emails of former
ministers that is undertaken in consultation with and via the Department
of Internal Affairs (DIA), who have access to the email accounts. This
process is lengthy and DIA advises it is likely we will need to do a
considerable extension to the timeframe for responding to your request
while they search for and locate any emails in scope. This will likely be
a 60 working-day extension.

 

Given that we are not aware of any documents sent to the former Minister
of Finance that would have been likely to be discussed or shared with the
Prime Minister or Cabinet colleagues, do you wish us to go ahead with the
search of the former Minister’s Parliament email communications relating
to central bank digital currencies?

Thank you for your request under the Official Information Act 1982 (OIA),
transferred from the Department of Prime Minister and Cabinet, to the
Reserve Bank of New Zealand - Te Pūtea Matua on 21 December 2023 for:

 

All advice/memos/reports/communications between Prime Minister and/or
Cabinet and the Minister of Finance (or acting Minister of Finance) which
refer to or discuss central bank digital currencies (CBDCs). From March
2022 – December 16 2023.

 

The Official Information Act 1982 requires that we advise you of our
decision on your request no later than 20 working days after the day we
received your request. Unfortunately, it will not be possible to meet that
time limit and we are therefore writing to notify you of an extension of
the time to make our decision by 60 working days, to 9 May 2024. We will
still provide you a response as soon as reasonably practicable, sooner
than this date if possible and without any undue delay.

 

This extension is necessary because the request:

(a) necessitates a search through a large quantity of information and
meeting the original time limit would unreasonably interfere with the
operations of the organisation, and

(b) consultations needed to make a decision on your request are such that
a proper response cannot reasonably be made within the original time
limit.

 

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
