Thank you for your email of 17 November 2023 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the following information:
Please provide confirmation on the number and physical addresses of all buildings across all
consent authorities that have been subject to a waiver of Building Code Clause C3.8, under section
67 of the Building Act.
I believe that this information is required to be held by MBIE and therefore should, equally, be
easily retrievable.
Please find below the addresses of the four buildings that have been subject to a waiver of Building Code
Clause C3.8:
1. 87 Charlton Road RD4 Gore 9774
2. 118-126 and 128 Ponsonby Road
3. 161-167 Main Street, Upper Hutt
4. 646B Glenbrook Road, Patumahoe, Pukekohe 2979
I note this information is based on the assumption that the waiver code clauses recorded against each
property in New Zealand has been correctly identified. However, to validate this information further
would require substantial collation and research by manually reviewing the building permit information
of all properties, which we are not able to do within our resources.
