Dear Te Pūkenga,

I am writing to you under the provisions of the Official Information Act 1982 to request information regarding the telecommunications spend of Te Pūkenga—New Zealand Institute of Skills and Technology (hereinafter referred to as "Te Pūkenga") over the past three years. Please consider this letter as a formal request for information.

I kindly request that Te Pūkenga provide the following information:

The total telecommunications spend incurred by Te Pūkenga across all business units, divisions, and subsidiaries for the period from 1 January 2020 to 15th June 2023 (or when this letter was received). Please break down the expenditure by financial year or calendar year, as applicable.

A detailed breakdown of the telecommunications spend, including but not limited to:

a) Expenditure on landline phone services, and the providers that are currently being served by each business division, if available, and when they were selected as part of a tender offer.
b) Expenditure on mobile phone services, and the providers that are currently being served by each business division, if available, and when they were selected as part of a tender offer.
c) Expenditure on internet connectivity and broadband services nationally.
d) Expenditure on data services, such as leased lines or dedicated circuits nationally.
e) Expenditure on audio or video conferencing services nationally.
f) Expenditure on any other telecommunication services or solutions nationally.

Any contracts or agreements related to telecommunications services that Te Pūkenga has entered into during the specified period. This includes contracts with telecommunications service providers or any other relevant vendors. Please provide copies of these contracts or, if not possible, a summary of their key terms.

Any relevant policies, guidelines, or procedures that govern the procurement and management of telecommunications services within Te Pūkenga.

Any internal reports or assessments conducted by Te Pūkenga regarding the efficiency, cost-effectiveness, or performance of telecommunications services during the specified period.

I understand that under the Official Information Act 1982, I am entitled to a response within 20 working days. If any aspects of my request are unclear or require further clarification, please do not hesitate to contact me via the details provided above.

I refer to your request for information under the Official Information Act
1982 (the Act) dated 15 June 2023. We are currently working on your
request, however would like to invite you to refine the scope of the
information you have requested. Some background context and our reasons
for inviting you to refine your request are set out below.

 

Background

As you may be aware, as at 1 January 2023 all 16 of New Zealand’s former
Institutes of Technology and Polytechnics (ITPs) and eight Industry
Training Organisations (also previously known as Transitional Industry
Training Organisations or TITOs) have officially become Te Pûkenga – New
Zealand Institute of Skills and Technology (Te Pûkenga). These former ITPs
and TITOs are now operating as ‘business divisions’ of Te Pûkenga.  

We note that Te Pûkenga only holds certain historic information of former
TITOs, from the date each TITO transitioned into Te Pûkenga Work Based
Learning subsidiary (WBL) between 2021 and 2022. This means that some
records held by TITOs before transitioning into Te Pûkenga cannot be
requested under the OIA as they do not exist.

 

Invitation to refine parts of your request

Your request as currently framed is very broad and would require a
substantial amount of research and collation. It also involves searching
for information that falls within scope from historic records of all 24
business divisions of Te Pûkenga.

The amount of time and effort required to grant your request as it stands
would have a significant impact on Te Pûkenga kaimahi (staff) ability to
carry out their other day to day operations. We therefore invite you to
refine your request as outlined below.

If you choose not to refine your request, we must consider whether to
refuse your request under section 18(f) of the Act.

We must also consider whether charging for the information or extending
the time period for making a decision would enable us to grant your
request. In this case we do not believe either of these options would
enable your request to be granted as it is currently worded. However, both
of these considerations may be viable options after any refinement of your
request is made.

If we were to charge, staff time is calculated at $38 per half hour, with
the first hour free. This is in accordance with Ministry of Justice
Guidelines. We anticipate it would take many hours to complete your
request as currently worded which would make the total fee significant.  

 

Suggestion for refining the scope of your request

In order for us to be in a better position to grant your request, we
recommend you consider refining it and narrow the scope of your request to
the previous 12 month period, rather than the previous 3.5 years.

If you were willing to narrow the scope of your request to a period of 12
months maximum, Te Pûkenga would be able to fulfil the request without
charging, however we would still require an extension to the normal 20
working day period for responding as set by the OIA.

Furthermore, as per section 12(2) of the Act any request needs to be
specified with due particularity. We particularly note your phrase “A
detailed breakdown of the telecommunications spend, including but not
limited to: as well as point (f) “any other telecommunication services or
solutions nationally”. We are not able to ascertain what it is you are
interested in receiving from the way point (f) is worded. If there is
something you have not specified in the rest of the list from (a) – (e)
that you would like to request, please let us know, otherwise we will
limit our response to this paragraph of our request to points (a)–(e)
only.

 

Please note this email does not constitute a final decision on your
request. As mentioned above, we may yet require an extension to the
timeframe for making a decision on the full request, or consider charging
for the information. If either or both of these decisions are made it will
be communicated to you as soon as possible, before any fee is incurred.

 

Next steps

Please let us know by Tuesday 11 July whether you wish to refine the scope
of your request.

If we do not hear from you we must proceed with our final decision, which
as outlined above may involve refusing parts of your request as it
currently stands.

Thank you for your message and your request for clarification and reduction of scope.

Based on your recommendation, I accept the suggestion to refine and narrow the scope of my request to the previous 12-month period instead of the previous 3.5 years. Therefore, I kindly ask you to provide the same data for the specified timeframe.

Regarding your comment on section 12(2) of the Act, I acknowledge the need for requests to be specified with due particularity. I understand your concern about point (f) of my previous request, where the wording may have been unclear. To clarify, in point (f), I am interested in receiving a detailed breakdown of any telecommunication services or solutions nationally that are not covered by mobile telecommunications spend (mobility). This includes investment into ICT, networking, video conferencing solutions, and/or cybersecurity solutions. For each telecommunications vendor (e.g., Spark, One NZ, 2Degrees), I request their service type (e.g., mobility/ICT cloud services) and the associated 12-month spend. If obtaining certain data would require an unreasonable amount of effort, please list those cases in bullet points, along with the reasons for their exclusion (e.g., time constraints or lack of data).

Furthermore, I would appreciate information on Te Pūkenga's plans to centralize their telecommunications contact. If decisions on which telecommunications vendor/supplier to use have already been made, please provide details. If such decisions have not been made, I would like to know the name of the department/business unit/chapter or tribe that holds the decision-making authority under the current Te Pūkenga organizational design. Please include this information when the message is received by Te Pūkenga staff.

If there is any additional information you require or any further clarification needed, please let me know. I anticipate your final response, including the requested information, no later than 20 days from the original receipt of this message.
