Dear Minister of Justice,
In the Sentencing Act 2002 it states that:
"In sentencing or otherwise dealing with an offender the court must take into account the following aggravating factors to the extent that they are applicable in the case:
the number, seriousness, date, relevance, and nature of any previous convictions of the offender and of any convictions for which the offender is being sentenced or otherwise dealt with at the same time:"
Please can you provide me with anything that the MOJ can find to say that this would preclude previous convictions that are held by Police Forces outside of NZ.
Also please provide me with any information on why it is that relevant previous offending in relation to Domestic Violence offences are not investigated by the Police or admitted to the Court during pre sentence hearings if they have been committed in a foreign country.
