1999 Election Complaints

Dear Electoral Commission,

In this historical story about the 1999 election (http://web.archive.org/web/2000022923202...) two complaints were mentioned as to be laid with the Electoral Commission: a complaint by Jeanette Fitzsimmons over scrutineers, and a complaint by Mark Gosche over a voting booth not being open. I would like to request under the Official Information Act: copies of those complaints, and copies of any rulings about these complaints by the Electoral Commission.

If any information is available then I would also like to request a list of all complaints lodged with the Electoral Commission over the 1999 General Election. This would be only a the title/subject matter of the complaint rather than the complaint itself in order to try to reduce the amount of work required.

Although not required under the OIA, I understand it is often useful to describe the reason why a person is requesting information. I am requesting them because I am a student of political science and law, and how electoral law functions is interesting to me.

Dear Mr Grainger,

 

Thank you for your e-mail of 12 June 2012 requesting information under the
Official Information Act 1982.

 

Having looked at numerous files from Archives New Zealand and offsite
storage, we have been unsuccessful in locating the information that you
are seeking.  For that reason your request is refused in accordance with
section 18 of the Official Information Act.

 

It is likely that the information is no longer available.  Under the File
Retention and Disposal Schedule agreed with Archives New Zealand under the
Public Records Act 2005, records relating to requests for information
relating to an election including inquiries re voting rights, polling
places etc are transferred offsite 3 years after an election has been
completed and then destroyed 6 years after the election has been
completed. 

 

You have the right, pursuant to section 28(3) of the Official Information
Act, to complain to an Ombudsman if you are not satisfied with my response
to your request.
