Statistics on data sharing between NZ and 'Five Eyes' partners

Dear Ministry of Business, Innovation & Employment,

With regards to the sharing of personal data for immigration purposes with NZ's 5 Eyes partners, please disclose the following information:

1a) In 2019 and 2020, how many outbound requests using biometric data (eg fingerprints) were sent each year by NZ to each of its 5 Eyes partners?
1b) Same as 1a) but for incoming requests received by NZ.

2a) In 2019 and 2020, how many outbound requests using biographic data (eg name, DOB) were sent by NZ to each of its 5 Eyes partners?
2b) Same as 2a) but for incoming requests received by NZ.

3. Please confirm whether the requests made by NZ (in relation to both 1a) and 2a) are done systematically or on a case by case basis.

4a) When there is a 'match' between a request and a country's database, what information is disclosed?
4b) Would it be possible to disclose a sample of the information exchanged following a match, with sensitive information redacted?

5a) According to information released by the UK, in addition to the 'High Value Data Sharing Protocol' between all 5 countries, the UK has also signed agreements and MOUs individually with each country allowing for the sharing of different types of data for immigration purposes. Could you provide a similar list of all such MOUs/treaties/agreements between NZ and its partners?
5b) Likewise, could you confirm the statistics given in response to Q1 & Q2 above relate to data shared under all agreements that NZ has signed, or only to the 'Data Sharing Protocol'?

On 21 June 2021, you asked the Ministry of Business Innovation and Employment (MBIE) for information under the Official Information Act 1982 (the Act). We are currently processing your request, however we would like to check under Section 12 of the Act, which provides that any person may make a request where they are:

* a New Zealand citizen; or
* a permanent resident of New Zealand; or * a person who is in New Zealand; or * a body corporate which is incorporated in New Zealand; or * a body corporate which is incorporated outside New Zealand but which has a place of business in New Zealand.

MBIE requires more information to establish your compliance with section 12. An original of any one of the following items is acceptable as a demonstration of your eligibility:

* A recent bill from the company who supplies your power, gas, water, phone or internet services * Council rates notice * A letter from the Electoral Office * Travel itinerary * Anything from a government agency that includes your name and address * Unexpired Rental or Tenancy Agreement.

A scanned copy of one of the above can be sent to INZOIAs @ mbie.govt.nz

Once MBIE receives this additional information from you, and is satisfied that the requirements of section 12 have been met, we will respond to your request. If you do not meet the eligibility criteria of section 12, MBIE will still consider your request. Please respond by 25 June 2021. If do not respond by 25 June 2021 your request will deemed to be withdrawn.
