Dear Waikato District Health Board,

I am a NZ citizen.

I am writing to request a list of all controlled documents at Waikato DHB which come under the Management of Policies and Guidelines (0102), Standing Orders –
Process and Documentation procedure (2524) and Management of Lippincott Procedures
policy (1236).

The Management of Policies and Guidelines policy defines controlled documents as: "Any document that requires approval by an authorised person within Waikato DHB as being a fit and proper document (e.g. policy, procedures, protocols and guidelines) for the purpose intended by the organisation."

The purpose being:
"Waikato DHB policies and guidelines advise and guide clinical and non-clinical staff,
patients and visitors on clinical procedures, administrative procedures and compliance
with legislative, regulatory and professional requirements."

I ask that you please provide this list in searchable electronic form (excel or PDF) and that you ensure the information is uploaded to FYI.org.nz.

You do not have my consent to search my medical records for my personal contact information.

Dear Waikato District Health Board,

I am following up with you as your agency is currently in breach of the OIA. Under sections 15 and 15A of the OIA you were legally obliged to respond to my request for information or notify me of an extension, with a specified date, within 20 working days. Twenty working days from the time of my request was 1 March 2021. Thus, you rganisation is now in breach of the OIA.

I request that the information be provided no later than 5 PM on Monday 8 March 2021. I note the Information and documents I requested must be readily accessible in accordance with the DHBs controlled documents policies on Waikato DHBs website, and in accordance with the Public Records Act and Electronic Transactions Act. Thus I have no doubt that you and your colleagues will be able to provide the documents and information by the specified date.

Complaint submitted to the Ombudsman and HDC 10 March 2021:

This is an official complaint against the Waikato DHB for failure to respond to an OIA request within the legislative time frame or to notify me of a delay in response, as required under sections 15 and 15A of the OIA. In refusing to respond to my requests, the DHB has also breached my rights to information as under sections 12, 21-24 of the OIA. In failing to uphold their legal obligations, they have breached Rights 4(2) and 7 of the Health and Disability Commissioner (Code of Health and Disability Services Consumers' Rights) Regulations 1996, referred to as the HDC Code.

Background - Request for list of controlled documents:
On 29 January 2021 I made a request to Waikato DHB for "a list of all controlled documents at Waikato DHB which come under the Management of Policies and Guidelines (0102), Standing Orders – Process and Documentation procedure (2524) and Management of Lippincott Procedures policy (1236)."

On 4 March 2021, I wrote to the DHB reminding them of their legislative duty. I also requested the information, which is readily available and accessible in accordance with the Waikato DHB Management of Policies and Guidelines (0102), to be provided by 5 PM on 8 March 2021. As of today, I have still not received a response or the requested information. I note that the requested list of documents are held in a centralized intranet policy page (as outlined in the DHB's publicly available Management of Policies and Guidelines (0102) page 7, section 3:

Thus, to satisfy my request all that was needed is for a person to go to the Finding Policies and Guidelines page of the DHBs intranet, then select (control+a), copy (control+c) and paste (control+p) the list into a word document or onto the DHB's Key Publications and Policies website.
