Dear R Rajan,

 

Thank you for your email of 23 November 2020 requesting under the Official
Information Act 1982 (the OIA), the processing timeframe for the second
person check aka 2PC.

 

Firstly, it should be noted that under Section 12 of The OIA, requests can
only be made by;

Any person, being-

(a) a New Zealand citizen; or

(b) a permanent resident of New Zealand; or

(c) a person who is in New Zealand; or

(d) a body corporate which is incorporated in New Zealand; or

(e) a body corporate which is incorporated outside of new Zealand but
which has a place of business in New Zealand,

may request a department or Minister of the Crown or organisation to make
available to him or it any specified official information.

 

From the limited information you have provided in your request it is
unclear that you are eligible to make an OIA request. Before we can
proceed with your request you will need to provide evidence that you are
eligible to make a request.  Proof of eligibility can be provided
confidentially to me via email which is shown in the attached file.

 

Please provide a response with evidence before 7 December 2020.  If no
response is received before this date, your request will be closed and
considered withdrawn on the basis that you are not eligible to make a
request under section 12 of the OIA.

 

Secondly, I note you have requested for the processing times for the
second person check. This information is not held in a reportable format,
average processing times are measured in calendar days from the time an
application is accepted for processing to when the application is
finalised in the Immigration system. Because an application at second
person check stage has not yet been finalised, the only way to provide the
information you have requested would require a staff member to manually
check individual applications to determine when an application was sent
for a second person check and when that second person check was completed.
It is therefore likely that the Ministry will refuse your request under
s18(f) of the OIA because the information cannot be made available without
substantial collation or research.

 

I can however provide that when an application has been assessed and a
decision needs to be finalised, the standard timeframe for when a quality
control check should be completed on an application is within 3 days of
the decision being made. The time it takes to complete this process will
however depend on a range of factors including, individual caseloads and
the on hand work of the individual offices.

 

Please let me know if you wish to proceed or withdraw your OIA request. If
you wish to proceed with your request please provide evidence you are
eligible to make an OIA request as noted above.

Hi Lautalie, 
   Good day. Thanks for your reply and the explanation of what is
happening with 2 person check currently.  I understand completely the
information is not held in reportable format. 
However, I would like to proceed with this request on behalf of all
immigrants. The reason for proceeding ahead is my application is with 2
Person check for almost six to seven weeks now with no clear information.
It would be really helpful for everyone and avoid our frustration and
stress level.
I am really sorry to trouble you on this.  As per your statement I am
happy to communicate in the FYI email address.

PS: We recently had our new born and my wife had c-section and she still
have pain in the tummy area. Only by getting residency we can travel to
our country and come back. Thanks for your understanding on this.
