Dear Department of Internal Affairs,

This is a request for Charities Services. It is not clear how Charities Services promotes trust and confidence in the charities sector. Please provide an explanation of this in detail. The website provides only vague information.
Please also provide an explanation of the structure of charities services and all of its roles and job titles and how many are in each job and how high the turnover has been in each job over the last seven years.

Could you please explain how you choose the leader of charities (not sure what the title is but manager, commissioner or whatever whoever it is in charge of running charities services). Could you please also provide information about everyone who has held this role for the last seven years. Thats their CVs, background experience and qualifications and their performance reviews while in the job and also performance reviews from before if they were in DIA before going to head charities. Could you please also provide all of this same information for the overall DIA chief executives over the last seven years too.

Could you please explain how you ensure that charitys registered with you are actually doing the charitable things that they say they are or doing charitable things at all. Can you also give numbers for the last seven years of how many charities you have actually investigated to make sure that they actually are and what you have done when you found out they werent.

I have also heard that you have rejected applications from charities that provide support services for people who suffer prejudice because of their unconventional (but entirely lawful) sexual preferences and that you did so in at least one case because the manager or commisioner (person in charge whatever thats called) rejected it because they themselves were part of that particular scene and was worried that might be found out if the charity was accepted and the media looked at it. Could you provide information about these and the official reason they were rejected. Could you please also provide any conflicts of interests that the manager/commisioner/whatever they are called has disclosed in the last seven years.Could you please explain how you prevent conflicts of interest from effecting weather a charity is registered or not.

Could you please provide the numbers of charities that send their reports to you and the number that are late or just dont send them in and explain what you do about the ones that dont file or dont file on time.

Thank you for your Official Information Act request made on 27 September
2019 to the Department of Internal Affairs - Charities Services. This
request (included below) sought information on a number of different
matters relating to the activities of Charities Services.

 

This email is following on from the advice provided to you on Wednesday 2
October 2019 that one item in your request has been transferred to the
State Services Commission.

 

This email relates only to the item included in your request, "Can you
also give numbers for the last seven years of how many charities you have
actually investigated to make sure that they actually are and what you
have done when you found out they weren’t".

As currently phrased a response to this request would require substantial
collation and research, as it is not clear what you are seeking when you
ask 'how many charities have you actually investigated'?

 

The process of substantial collation and research arises because the
meaning of 'investigation' is very broad, as it involves "to examine
something carefully to discover the truth about it". In terms of Charities
Services activities, in its most general terms, this request can
encompass:

- phone calls and other emails with a charity seeking advice on their
activities as a part of the assessment of whether the organisation has a
charitable purpose (covering all of the approximately 27000 currently
registered charities) ;

- communications arising after receipt of a complaint about a charity; and

- conducting a formal inquiry under the provisions of the Charities Act
2005.

The scope of your request would require the Department to undertake
substantial collation and research to be able to answer it, and this would
be likely to disproportionately impact the normal operation of the
Department.  We have considered whether extending the timeframe for
response or fixing a charge would enable your request to be answered,
however neither option is suitable as the time needed cannot be accurately
estimated.  For this reason, the Department is considering refusing your
request.

I am contacting you in order to give you the opportunity to refine your
request to enable it to be answered without substantial collation and
research.  

To assist us to provide the information you are seeking, we are asking if
you can clarify your request on how many charities gas Charities Services
'actually investigated'? If you can explain what you mean by ‘actually
investigated’, or what is the outcome that you are seeking relating to
Charities Services engaging with charities that would be useful.

 

Also we are not sure what you are seeking where you seek information about
"to make sure that they actually are and what have you done when you found
out they weren't'. Please can you clarify what information you are seeking
when you ask "to make sure that they actually are and what have you done
when you found out they weren't?'

 

Please contact the Department as soon as possible to advise whether you
would like to refine your request’s scope.  If we do not receive response
from you by Monday 14 October, a decision will be made on this item in
your request, and this may result in this item being refused.
