I request under the Official Information Act ( Local Government and Meetings) the following information:
1. The numbers and locations of all new cellphone towers approved by the TCDC Planning Department and proposed to be erected on the Coromandel Peninsula 2019 - 2021.

2. The Minutes of any Council meetings or internal emails where new cellphone towers were discussed.

3. The Council's views on why the location of these new towers has not been subject to community consultation in each location.

Can you please refine your search to help with obtaining the information. How far back would you like the search to go for minutes of Council meetings and do you wish to include Community Board Minutes?

Also what time frame are you wanting emails for relating to this subject?

Please be aware that under the Local Government Official Information and Meetings Act 1987 Council may impose a charge for the information supplied. These charges are set in the Council's Long Term Plan. The first hour is free and then $76.00 per hour thereafter. If there were any charges involved we would contact you prior to this occurring.

I wish to amend my request and reduce the scope of it to two questions.
Request 1: The numbers and locations of all new cellphone towers approved by the TCDC Planning Department and proposed to be erected on the Coromandel Peninsula 2019 - 2021.
Request 3: The Councils views on the requirements ( or lack of ) for community consultation processes in the siting of these proposed cellphone towers.

Hello – Further to your email received amending your request for
information, in relation to point 1 a search of our system for 2018 and
2019 shows the following consents for telecommunication facilities for the
three main providers, spark, Vodafone and 2degrees. Given we do not know
about applications until they are lodged with the Council and we do not
have a cell tower strategy, we can only inform you about information we
hold. We cannot comment on future applications the Council may receive in
2020 or 2021:

the TCDC website

second one down on the list

3. On the RHS of the page, click on 'Application/Consent Tracking'

4. Add in the consent number and this will give you all information for
each consent.

Where an activity is permitted within the District Plan the Council's role
is to issue a Certificate of Compliance under Section 139 of the Resource
Management Act 1991 applications to either install, operate and maintain
some mobile cellphone towers.

A Certificate of Compliance is a certificate stating that particular
activity can be done lawfully in a particular location without the need
for a resource consent. Importantly the Local authority must issue the
certificate and cannot withhold it, if the activity meets the relevant
permitted standards. Importantly a Certificate of Compliance is not a
resource consent and therefore the council does not have the ability to
consult with the public in relation to a permitted activity

The main provisions that apply to a Certificate of Compliance are the
National Environmental Standards for Telecommunication Facilities 2016
(NESTF) and the Proposed District Plan.  The NESTF provides national
consistency in the rules surrounding the development of telecommunications
infrastructure across New Zealand. The permitted standards for
Telecommunication Facilities in the Proposed District Plan have gone
through an extensive public consultation process and followed the Schedule
1 Process under the RMA 1991.
