Further to your email update request of Friday last week, we still await the LINZ approved SO Plan
before we can commence public notice (40 days). Refer email below as to when both parties had
approved the draft on 4 July and instructed the surveyor.
We also await a reply from TPG regards the draft land exchange agreement that was provided in
word format (for ease of mark-up) on Friday 22 June 2018.

Apologies for the delay. We wanted to check out the implications of the adjacent titles (gaz.
notices ) that are limited as to parcels. Technically the definition of the "road to be stopped" 
boundary with lots 20, 22 and 24 Deeds Plan 27 should be agreed to by the owner of that
land. This is now probably MOE. Wellington City Council may also have to agree to the new
boundary.

We will prepare CSD and Title Plans for an SO that will show Sections 1 and 2. Section 1
will be land to be declared road under the PW Act and Section 2 will be road to be stopped.

Our fee to determine the new boundary positions and undertake the survey to peg the
boundaries and prepare and lodge the SO plan at LINZ is 9(2)(i)

I understand that you have already been looking into this for John Vriens at WCC.

As a bit of background; WCC and MOE are looking to complete a land-swap at the end of the street
to formalise Thorndon Schools use of the land at the end of the street, and to provide a vehicle
turning head for the public.

Please see the attached PDF’s showing the two parcels of land which will be exchanged between
the two parties [TH07] and plan and perspective views to help better understand what we are
trying to achieve.
Hopefully, this work will be simplified as it follows on directly from the topo and boundary survey
that Adamson Shaw conducted for us, on behalf of the MOE earlier this year.
The property teams from WCC / MOE will be able to confirm how the transferred land is to be
allocated to the existing titles.

My apologies for not getting back to you sooner.  Wendy O’Neill at the Council asked each of the
submitters (in objection) if their contact details could be passed onto the MoE.  This was for me
to be able to provide the submitters with additional information.  Some said yes, others no.  I
have now contacted all of those that said yes and three of those have formally withdrawn their

objections.  We still, however, have objectors that want to give oral submissions at a Council
meeting.

Wendy and I discussed next steps earlier this the week.  Wendy will now follow the LGA/Council
process and have this matter discussed at the relevant Council meeting (date to be advised). 
 The MoE will also be present at this meeting.  It may be beneficial to also have a representative
from the School (yourself or a Board member?) – Wendy and I will confirm this with you as soon
as we can.  After the meeting, the Council deliberate on whether they uphold the objections or
not.  If the Council uphold the objections, the road stopping doesn’t happen.  If the Council do
not uphold the objections, the matter is referred to the Environment Court. 
When deliberating this matter, the Council do take into account the overall number of

submissions and the ratio of for/against.  In this matter there have been more submissions in
favour than against.  Also, there will be a discussion with the objectors before being referred to
the Environment Court.  There are costs associated with the Environment Court process.  The
objectors may not be aware of this.  If the objections are seen to be vexatious, costs can also be
sought.

Act 
An aerial is attached for your reference. The Ministry of Education owns the land on all 3 sides of the proposed road
to be stopped. In return they will vest land in council as road to provide a much needed turning area as this is a very
narrow road.
As part of the exchange the Ministry will pay for the construction of the turning area and reform the proposed
stopped road land to include a gate, paving seating and planters to provide a safe transitional area from the main
school building to the playing fields at their cost.
The Ministry are unable to formalise legal access through the school grounds due to their legal obligations of Duty
of Care to the children under the Education Act and Vulnerable Children’s Act. This is primarily to allow them the
ability to serve trespass orders on any undesirable person who comes within the school grounds to have them
removed for the protection of the children and school property.
Council has no control or statutory powers over the access across the Ministry of Educations land and cannot
enforce any permanent rights of access.
The Ministry of Education has undertaken to give assurances that they have no future intention to prevent public

access through the school and the current arrangement can remain.
The only two landowners whose land physically and legally adjoins the area to be stopped have provided their
written consent in writing to council
John can brief you (and any other committee members?) in person further before the 21st  meeting. He will send you
an Outlook meeting invite to do that and use one of the Councillor meeting rooms next to the committee rooms.
