Thank you for your email of 24 June 2026 to the Department of Corrections – Ara Poutama
Aotearoa, requesting further information regarding the Severance provision in Collective
Agreements, fol owing our previous response to you on 16 June 2026 (our reference
C214725). Your request has been considered under the Official Information Act 1982 (OIA).
You requested:
I would like an explanation as to why the 'Severance Clause' contained in the 2019-
2021 Col ective Employment Agreement, (and prior Col ective Employment
Agreements) was omitted from the 2021-2023 Col ective Employment Agreement?
The Severance provision is contained under clause 10.1.3(h) in both Collective Agreements.
Therefore, your request for an explanation as to why the provision was omitted from the
2021-2023 Col ective Agreement is refused under 18(g) of the OIA, as the information
requested is not held by Corrections and we have no grounds for believing it is held by
another agency or connected more closely to the functions of another agency.
