OIA: GEMS-47911 – OIA requests involving schools in the Franklin District 
Thank you for your email of 29 April 2026 to the Ministry of Education (the Ministry) 
requesting the following information:  
I am interested in understanding how many OIA requests have been made in 
the past 12 months (April 2025 - April 2026) which involved schools in the 
Franklin District - Auckland. 

Your request has been considered under the Official Information Act 1982 (the OIA). 
On 7 May 2026, the Ministry sought clarification regarding the type of school 
involvement you were referring to in your request so we could reasonably identify the 
information requested. As we have not received a response to this clarification 
request, we are responding to the wording of your request as is.  
As a result, the Ministry is refusing your request under section 18(g) of the OIA, as 
the as the information you have requested is not held by the Ministry, and I have no 
grounds for believing that it is either held by, or more closely connected to the 
functions of, another department or organisation subject to the OIA.  
As outlined in our email to you on 7 May 2026, the Ministry is responsible for 
responding to requests for official information that the Ministry holds. Schools are 
self-governing and are responsible for responding to requests for information that the 
school holds. The Ministry has no oversight of OIA requests made to or responded to 
by schools, and is not involved in supporting schools to respond, as we are a 
separate decision-making entity under the legislation. 
We may receive requests for information about specific schools, but if the information 
requested is not held by the Ministry, or it is more closely related to the functions of 
the school, then the legislative requirement is for the Ministry to transfer that request 
to the school to respond. 
In other circumstances, when the Ministry is responding to a request for information 
that we hold or that is more closely related to our functions, we may need to consult

with specific schools on the release of certain information if it involves that school. 
However, the Ministry’s workflow system does not capture that engagement in such a 
way that we could report on it to respond to your request.
